The proposed use, with conditions, would not be injurious to the public health, <br /> safety,welfare,decency,order, comfort,convenience, appearance or prosperity of <br /> the City in that the drive-thru would be consistent with current traffic patterns in <br /> this area. <br /> 12. The proposed use will not impair values nor substantially diminish properties in <br /> the immediate vicinity. <br /> 13. The proposed use, with conditions, will not impede the normal and orderly <br /> development and improvement of surrounding vacant properties. <br /> 14. The proposed use will not create a cost for additional public facilities or services. <br /> 15. The lot is already established with vehicular approaches to the property. <br /> 16. The parking standards for this use have been met. The proposed use also allows <br /> for loading space. <br /> 17. The requested use will not create any additional odor, fumes, dust, noise or <br /> vibration than the current use of the property. <br /> 18. There are no indications that the proposed use will cause any pollution to ground <br /> or surface waters. <br /> On the Conditional Use for Additional Signage: <br /> 1. The request for a conditional use permit is to allow additional free standing signs <br /> along with the redevelopment of an existing nonconforming sign to include a <br /> reader board that would not conform with Section 17-7.1(4)(C) which outlaws all <br /> flashing, revolving or intermittently lit signs. Section 17-7.1(5)(A)(6) allows for a <br /> sign concept plan for anything that is not allowed in the sign section. <br /> 2. All signs, except the existing sign, will meet the one foot setback requirement. <br /> The existing sign appears to be on or just over the property line or edge of the <br /> Highway 371 right-of-way, although an exact setback is not shown. <br /> 3. The applicant is proposing to reface the existing pylon sign that is nonconforming <br /> due to right-of-way setback, size and height. The sign will not be increased in size <br /> or height but will be intensified with an electronic reader board. <br /> 4. The refacing of the existing sign and the additional free standing sign located in <br /> the drive-thru will be coordinated to create an overall appearance for the Dairy <br /> Queen and the other businesses already established in the existing development. <br /> 5. The existing pylon sign is a total of 192 square feet per side for a total of 384 <br /> square feet.This is a preexisting nonconformity. <br /> 6. The directional drive-thru sign is approximately three and a half square feet <br /> (counting both sides) and just under four feet in height. This would be allowed as <br /> the property is a corner lot and each corner is allowed one free standing sign. <br /> 7. The additional signage that is being requested beyond the two free standing signs <br /> (one on each corner) is the order menu for the drive-thru. This sign is <br /> approximately 40 square feet and just under eight feet in height. This sign would <br /> be behind the proposed building and only visible to drive-thru traffic. <br /> 8. The signs being proposed on the front facade add up to a total of approximately <br /> 142 square feet. The size of the existing sign for Sarie's Place is unknown. The <br /> total square footage of signage allowed is 263 square feet (ten percent of the <br /> facade area of 2,629 square feet). It does not appear that the sign for Sarie's Place <br /> exceeds the remaining 121 square feet allowed for facade signs. <br /> 9.
