Dan Helbling
April 28,2011
Page 2
ur
On April 261 did a field review to make contact with both you and Charles Peterson, your
neighbor to the north whose land shares the highway access. I met with Mr. Peterson and
explained Mn/DOT's position to him. He stated he uses the entrance occasionally but
would not object to its removal. His house access is from Hurtig Road, and even if he
someday does split off some highway frontage land for commercial development he has
legal access to this frontage via an easement from the entrance at Tasty Pizza North.
You said Troy and Jenny Cline are the owners of Lot 1 and this entrance is their only
convenient highway access at this time. Lot 1 is part of the plat and Mn/DOT's position is
that you were aware of the entrance removal requirement and there has been sufficient
time by now to construct alternate access to Hurtig Road for Lot 1. The Clines should've
been made aware of the entrance closure possibility by you when they purchased Lot 1.
That said, Mn/DOT will delay the entrance removal for a couple weeks while we sort out the
details and City position. We will also verify with the Clines what they were told about this
access and potential impacts to them like school bus use and access options thru the RV
Park road system if the entrance is removed. It is not our intention to create hardships for
anybody, but our priority is highway safety and we feel this is an important item that was
identified years ago as a beneficial safety improvement.
Please send me—by May 6-the latest copies of the final approved/recorded plat and any
other information you have to support your request to leave this entrance open. It's my
understanding that Dawn Bittner will be bringing the issue up with the Planning Commission
ASAP, and then we'll talk and get this resolved.
Thank you for your cooperation and immediate attention to this matter.
Sincerelyh
Ken Larson
Maintenance Specialist
Attachments: Correspondence—Plat Sheets- Construction Plan Sheet—Commission Minutes
Cc: Gary Dirlam —Jim Hallgren — Paul Konickson —Oawn,Bittner, City of Pe not Lake-Chuck
Marohn, Community Growth—Charles Peterson—Troy Cline
