Box 488 <br /> Pequot Lakes, MN 56472 <br /> Mr. Helbling: <br /> Re: CS 1810, TH 371 in Pequot Lakes <br /> Removal of Shared Highway Entrance (RV Resort Village at the Preserve/Peterson) <br /> RP 49.57/Station 904+00, west side <br /> As per the attached correspondence (some of which you said you didn't get, don't know <br /> why, letters were never "returned to sender"), for safety reasons Mn/DOT has requested <br /> the removal of the TH 371 entrance in the northeast corner of your parcel as a condition of <br /> the RV Resort development changes. This has been our position since initial discussions <br /> with you beginning in December 2005 and you acknowledge knowing that. The current TH <br /> 371 paving project from Baxter to Nisswa includes left turn lane construction at the CR <br /> 168/CR 107 intersection and this entrance removal has been noted in the plans as part of <br /> that work. Our position is that both landowners affected by this removal meet reasonable <br /> access criteria to get to TH 371 via Hurtig Road and CR 168. Removal of this entrance would <br /> improve safety by eliminating a potential congestion and accident point in an area of <br /> turning movements with a public road directly across the highway and less than ideal sight <br /> distance to the north. <br /> We thought the City of Pequot Lakes supported the no entrance to TH 371 condition and <br /> that all access for the entire plat should be from Hurtig Road. But I'm getting conflicting <br /> and/or outdated info from both you and the City regarding the Lot 1 use of and emergency <br /> use of this highway entrance. I have copies of what appears to be the final recorded plat <br /> dated 12-11-08 (must've come from you at that time), and these two sheets don't mention <br /> or show this highway access at all. But the City just emailed me Planning Commission <br /> Minutes from February 15, 2007,that state in two different sections "The private road may <br /> only be utilized by the occupant of Lot 1, except in an emergency situation where there <br /> shall be no restriction." I'm waiting for clarification from the City on what they meant by <br /> "private road" (the driveway road to the highway entrance or internal road from the house <br /> to the rest of RV Park roads?). Also, these minutes are 22 months prior to the dates on the <br /> final plat, so I'd assume there's later more official City information somewhere regarding <br /> their final conditions for final plat approval. Hurtig Road is a north-south thru street so <br /> emergency access shouldn't be needed from the highway. Access to Hurtig Road for the Lot <br /> 1 house would be a change and inconvenience for them to go thru the RV Park, but may be <br /> a necessary condition for the overall public safety benefit of one less highway entrance. <br /> An Equal Opportunity Employer <br /> 1 0" <br /> { <br />
