S.P. 1810-92(T.H. 371) <br /> Agreement Number 1000912 <br /> Utility Owner will operate all valves and supervise all shut-offs and disconnections for the <br /> construction of the Utility Work. The Utility Owner must notify MnDOT in writing of all <br /> cases of a performing party's noncompliance no more than fourteen Calendar Days after <br /> the Utility Owner knew or should have known of the noncompliance. <br /> IV. Real Property Interests <br /> A. If the Utility Owner is requesting reimbursement for the Utility Work because it <br /> owns a compensable property right, the Utility Owner must provide MnDOT with <br /> copies of its property rights documents for the existing real property interest with <br /> any Work Order involving such instruments. The Utility Owner will have the <br /> burden of proof to demonstrate that it actually owns such existing real property <br /> interests. MnDOT will not unreasonably withhold its Approval of these documents. <br /> B. The Utility Owner must convey, by Quitclaim Deed, all of its right, title, and interest <br /> in property located in Crow Wing County, Minnesota that lies within the trunk <br /> highway Right of Way of the Project, to MnDOT. The Quitclaim Deed must be in <br /> the form set forth in the Work Order and the Utility Owner must sign it to receive <br /> final payment for the Work Order. <br /> V. Coordination <br /> The Utility Owner, MnDOT, and the Contractor will coordinate their efforts and cooperate <br /> with each other to ensure that the party performing any work does so promptly and <br /> without disturbance to other Project work, minimizes delay and uncertainty, and <br /> eliminates excess cost. Coordination will include the following tasks. <br /> A. Initial Coordination Meeting: When the party preparing the plans achieves a level <br /> of design where utility conflicts can be determined, the Contractor and the Utility <br /> Owner will conduct an initial coordination meeting before beginning the Work <br /> Order process. At this meeting, the Contractor and the Utility Owner will address <br /> pertinent information for the Utility Design Sheets (UDSs) and discuss potential <br /> conflicts. Once the Contractor has the UDS information, a preliminary level of <br /> design, and estimated costs, it will schedule a meeting with MnDOT and the Utility <br /> Owner to: <br /> 1. Review the Final Design and construction schedules for the work at each <br /> UDS location; <br /> 2. Review proposed conflict resolutions; <br /> Page 6 of 28 <br />
