S.P. 1810-92(T.H.371) <br /> Agreement Number 1000912 <br /> 1. Title 23, Code of Federal Regulations, Part 645, and the edition of the <br /> FHWA Program Guide: Utility Adjustments and Accommodation on Federal <br /> Aid Highway Projects (Federal Regulation), in effect at the execution of this <br /> MUA, and any subsequent amendments and replacements; <br /> 2. MnDOT's Policy for Accommodation of Utilities on Highway Right of Way; <br /> 3. The Notice and Order; and <br /> 4. All exhibits and policies referenced herein. <br /> C. General Criteria and Standards: All Utility Work must be consistent with this MUA <br /> and the Utility Owner's current, reasonable, written specifications; standards of <br /> practice; construction methods; and any applicable Utility Permit requirements. <br /> 1. If the Contractor is performing the design, the Utility Owner must provide <br /> the necessary written specifications, standards of practice, and construction <br /> methods to MnDOT and the Contractor no later than the beginning of the <br /> design. If the Utility Owner does not provide these documents, the <br /> Contractor will be under no obligation to follow them. <br /> 2. If the Utility Owner is performing the design, it must provide all current <br /> written specifications, standards of practice, and construction methods to <br /> MnDOT and the Contractor no later than the date the Work Order for the <br /> Utility Work is signed. <br /> D. Plans: The plans for the design of the Utility Work must show at least the existing <br /> topography, Right of Way, lanes of travel, the x and y coordinates of the Facilities' <br /> location, and the z coordinate of the Facilities' location, if applicable. <br /> 1. The most recent plans and specifications will govern the scope of the Utility <br /> Work. When the final plans are completed they will supplement or replace <br /> any previous plans or specifications, as applicable. <br /> III. Quality Management <br /> The Utility Owner will be responsible for the quality control of all Utility Work, regardless <br /> of which party performs it. Any quality control that the Contractor elects to provide for the <br /> Utility Work will be in addition to, not in lieu of, the Utility Owner's quality control. The <br /> Page 5 of 28 <br />
