MEMORANDUM MINNESOTA LAND TRUST MINNESOTA To: John Erickson,Nancy Adams, and Joshua Stevenson LAND TRUST From: Anne Murphy Date: July 30,2012 Re: Meeting summary and next steps for the Mayo Lake(O'Shaughnessy)property Thank you all for meeting with Kris Larson and me last week to discuss the proposed gift of the O'Shaughnessy property. It was a positive meeting.As you know,the Minnesota Land Trust holds a conservation easement on the approximately 65-acre property on Mayo Lake. The conservation easement specifies that the property may be conveyed only in its entirety as a single parcel,regardless of whether it consists of or was acquired as separate parcels or is treated as separate parcels for property tax or other purposes. While amendments that advance the conservation values and purposes of conservation easements may be permitted under the Land �., Trust's amendment policy, the state fiends used in the protection of this property adds an uncertain element to the mix. Ideally,the property would be conveyed in its entirety to an organization or entity for use as a passive public park,thus avoiding the need for an amendment. The Land Trust typically does not own land long-term,but could potentially be an interim owner while the overall plan for the property comes together. Cass County,while not interested in owning the property,expressed interest in holding on to their 12-acre tax-forfeited parcel adjacent to the property while this overall plan comes together.The 12 acres could provide parking, trail access, or facilities to support the passive park uses on the O'Shaughnessy property. Potential long-term owners of the property include the City of Pequot Lakes and the Minnesota DNR. Next steps in our discussion include: City of Pequot Lakes- • Speak with the city attorney about whether or not the city can accept a donation of land outside of the city boundaries • Approach the park board about the concept of a regional park that would include approximately 8 acres in Crow Wing County and 57 acres in Cass County • Approach the Mayo Lake Association about access and parking related to the 8 acres
