Planning Commission Direction: The Planning Commission may develop findings <br /> to approve the metes and bounds subdivision, develop findings to deny the metes and <br /> bounds subdivision, or table the subdivision request to gather additional information on <br /> which to base a decision or to provide the applicant time to modify the proposal. <br /> Staff Recommendation: Since the proposed lot split is to correct a non-conformity, <br /> created by the property owner, we cannot recommend the subdivision be approved. The <br /> property owner was granted a land use permit to build the structures at or beyond the <br /> setback requirement. <br /> If the variance to create an undersized lot was approved earlier in the meeting, we <br /> recommend that this application be approved with the following condition: <br /> 1. So as to correct the remaining non-conformities,the 20'x 20'accessory structure <br /> shall be removed. <br /> If the application is denied, all three of the encroaching structures should be removed. <br /> The impervious surface coverage encroaching the property line should also be removed <br /> and replaced with vegetation that was removed.We would advise tabling this application <br /> so that the City Attorney can be consulted prior to a final decision on denial. <br /> Pequot Lakes Staff Report 7(b)-4 <br /> January 19,2012 <br />
