ry <br /> V UN. � <br /> INSTITUTE <br /> STAFF REPORT <br /> Application: Ordinance Amendment Regarding Fence Height in the Neighborhood <br /> Residential Zone <br /> Applicant: City of Pequot Lakes <br /> Agenda Item: 4(a) <br /> Background Information: The ordinance currently allows fences in the <br /> Neighborhood Residential Zone to be no higher than 6o inches (5 ft) in both the front <br /> and rear yard. Typically, the back yard of a property is a private space and the front <br /> yard,while still private property, acts more as a public space since it can be viewed from <br /> the public right-of-way. <br /> Standard pre-made fences usually come in 48 inch (4 ft.) or 72 inch (6 ft.) heights. The <br /> proposed amendment increases the allowable height of fences in the rear yard of a <br /> property from 6o inches to 72 inches. The maximum height allowed of a fence in the <br /> side yard and front yard remains at 6o inches with the proposed amendment. <br /> Planning Commission Direction: The Planning Commission may either recommend <br /> that the application be approved or denied, with or without changes to the text provided <br /> here. <br /> Staff Recommendation: Since the increased height in the rear yard of the property <br /> does not affect the public realm, we recommend the proposed amendment be approved. <br /> We also suggest considering lowering the maximum height for front and side yard fences <br /> from 6o inches to 48 inches.
