City Council Minutes <br /> June 3, 2014 <br /> Page 3 of 4 <br /> ----------------------------- <br /> Mayor Adams questioned whether Mr. Dahl had received the letter <br /> regarding a notice of immediate corrective action from the Attorney sent in <br /> February. Mr. Dahl indicated that he did receive the letter, that he talked to <br /> Dawn Bittner and that he has taken care of all the stuff that was supposed <br /> to be cleaned up. <br /> Council Member Pederson stated that the City has records of the past <br /> many years on this issue. He informed Mr. Dahl that Planning and Zoning <br /> has worked with him many times during the past several years on this <br /> issue. He informed Mr. Dahl that all of the stuff on the ground needs to be <br /> gone. He further explained the need for the City to take action on this <br /> issue due to the number of years that this situation has been on-going and <br /> due to the number of complaints the City has received and continues to <br /> receive. <br /> Mayor Adams closed the public hearing. <br /> Attorney Robert Scott reviewed the findings of fact and conclusions listed <br /> in a resolution. He informed the Council that the findings have to be based <br /> on the evidence. He recommended that because Mr. Dahl has testified <br /> that he doesn't have the animals listed in the resolution that the Council <br /> omit paragraph 2d XII under findings. He explained that the Resolution <br /> gives the property owner until June 17th to come into compliance. If the <br /> conditions are not met by the 17th, a court order to have property cleaned <br /> up will be requested. He also suggested that if the property owner makes <br /> a good faith effort and is nearly done with the clean-up by the 17th, the <br /> City can make a judgment to extend the time for a couple of weeks. <br /> Mayor Adams questioned Mr. Dahl as to whether the City would be <br /> allowed to access his property to see that improvements have been made. <br /> Mr. Dahl indicated that he would allow the City to access the property but <br /> he did not want any pictures taken of the property. <br /> Council Member Sjoblad informed Mr. Dahl that once this is cleaned up, <br /> the City does not want it to start over again. <br /> MAYOR ADAMS MOVED TO ADOPT RESOLUTION 14-10 FINDINGS, <br /> CONCLUSIONS AND ORDER OF PEQUOT LAKES CITY COUNCIL <br /> REGARDING ALLEGED CODE VIOLATIONS AND NUISANCE <br /> CONDITIONS AT 3952 COUNTY ROAD 17, AND OMITTING ITEM 2D <br /> (xii) REFERRING TO THE ANIMALS. COUNCIL MEMBER SJOBLAD <br /> SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> 12. Adjournment <br />
