To: Pequot Lakes Planning Commmission <br /> From: Ann Beaver, Cullen Lakes Association(CLA)president <br /> Re: dock placement at Wilderness Resort Villas (WRV) <br /> Date: July 25, 2014 <br /> Dear Planning Commission members: <br /> On July 14, 2014, I submitted to Wayne Mueller, DNR Aquatic Plant Supervisor, four photographs given to me <br /> by a Middle Cullen resident showing one of WRV docks that has boat mooring spaces in the emergent <br /> vegetation(bulrushes and water lilies). I asked him if there was anything the DNR could do to make the resort <br /> adhere to a condition placed on its CUP approval that it not moor boats in any emergent vegetation. Wayne <br /> emailed me back on July 17. I include here the entire text of his email to me. <br /> Ann, <br /> I was on the lake last week and I too noticed the docks were once again placed within <br /> the bulrush. With the addition of about two more sections, the bulrushes would not be <br /> an issue. <br /> I have discussed this with Hydrologist Heidi Lindgren and we agree that this should be <br /> brought up to Pequot Lakes P&Z, since they were party to the agreement with Tim <br /> Brastrup, et al. This may have been a requirement of the original plat approval, I don't <br /> know. I can't really refer this to DNR Enforcement as the present dock placement is not <br /> illegal, albeit it is ill-advised. <br /> Since few of you were on the Planning Commission in 2005 —2008 when this all was being discussed and <br /> decided, I have put together the important background facts. Dawn Bittner may be able to add more <br /> information to flesh out what I include below. <br /> May 5,2005 City Council minutes <br /> Item 5.1 Council member Nagel's second paragraph: "In place of my vote for denial I would vote to approve <br /> said request,pending acceptance of an additional condition, the condition being that the placement, design,and <br /> construction of the proposed docks and boat slips meet with the approval of the Minnesota DNR, and thus <br /> minimize any adverse environmental impacts on Middle Cullen Lake." <br /> Council member Greer's motion to approve the CUP contained the additional condition: "The placement, <br /> ��'esign, and construction of the proposed docks and boat slips meet with the approval of the Minnesota DNR, <br /> d thus minimize any adverse environmental impacts on Middle Cullen Lake." Motion carried 7-0. <br />
