April 17,2008 Planning Commission minutes <br /> APPLICANT: Wilderness Resort Villas,LLC <br /> -kpplicant requests a Conditional Use Permit <br /> " ''Condition of approval #11: "The placement of the docks shall be done at the direction and recommendation of <br /> the Department of Natural Resources." Motion to approve the CUP carried unanimously. <br /> December 16, 2008 letter from Tim Brastrup,then Areas Fisheries Supervisor(since retired),to Dawn <br /> Bittner <br /> Excerpts from the letter: <br /> "I found that the three proposed mooring facilities would not involve the removal of emergent aquatic plants. ... <br /> The main docks at the two mooring facilities on the east side of the property would bisect the bulrushes, <br /> however, as stated by Mr. Miller,there would be no plant removal at these two facilities. The boat slips would <br /> be situated lakeward beyond the outer limits of the bulrush stands at both east side sites." <br /> "Since the boat slips will not be situated within the bulrush stands and the main docks will be installed over the <br /> top of the bulrushes, disturbance to the bulrush stands, and essential fish life cycles, as I anticipate, will be <br /> minimal. In the event that the lake water level drops and the bulrush stands expand further lakeward, the main <br /> docks should be extended so the boat slips are again not located within the emergent plant stands, ..." <br /> End of background facts. <br /> As you already know, WRV was cited by the DNR last year for removing a substantial number of bulrushes. <br /> So Mr. Miller's comment in line 3 of paragraph 1 is not true. Since the boat slips are within the bulrush stand <br /> nd water lilies for the second straight year,the last sentence in the first paragraph also is not the case. <br /> The CLA respectfully asks you to uphold condition#11 of the CUP approval and require WRV to extend its <br /> dock the necessary number of sections to place the boat mooring spaces lakeward, outside the stand of bulrush <br /> and outside the water lilies.
