i. Provide that emergency motorized vehicles dispatched by police or fire <br /> departments or medical aid providers be allowed to utilize the walking paths; <br /> 2. Provide that resort maintenance personnel be allowed to utilize the walking path <br /> with motorized equipment and vehicles for maintenance purposes including but <br /> not limited to installation, repair and removal of docking systems, non-motorized <br /> watercraft, beach chairs, etc. and motorized equipment for maintenance and <br /> repair of the pathway and surrounding vegetation, including permitted trimming <br /> and removal of deadfall and invasive plant species. <br /> 3. Provide that resort guests may use electric golf carts to access the beach and boat <br /> dock area. <br /> There was a significant amount of discussion during the original CUP review process <br /> regarding the use of the "walking trail' near the lake. It was ultimately determined that <br /> the trail should be used for walking and that it should be restored to a condition that has <br /> less impact on the lake. <br /> Staff conducted a site visit of the property in August 2013 and determined condition <br /> number 12 had not been met. The path consisted of hard-packed material(not pervious) <br /> and it was clear the path was being used by more than just pedestrian traffic. The <br /> property owner was directed to remove the impervious material and replace it with a <br /> pervious material (e.g. mulch) and install a blockade and signage at the entrance of the <br /> "walking path;" notifying guests and resort staff the path may be used be pedestrians <br /> only. <br /> Conditions to Consider: <br /> 1. The road in the bluff and shoreline setback shall be removed and re-vegetated. <br /> An 8-foot wide walking trail may replace the road; however, all automobile traffic <br /> shall be banned. The walking trail shall be constructed with pervious materials. <br /> 2. A gate or other movable device acceptable to the Planning Commission shall be <br /> place at the entrance of the walking path. The device must be movable so that <br /> emergency personal may access the dock area. <br /> 3. On a seasonal basis, resort personal may access the docking area with motorized <br /> vehicles to install/remove docking systems. <br /> Applicable Regulations:The following regulations apply to this property: <br /> Section 17-5.11 SHORELINE COMMERCIAL (SC) <br /> 1. Intent and Purpose: To establish and maintain a land use district for <br /> existing commercial, recreationally orientated uses within the shoreland area <br /> comprised of campgrounds, resorts, bars restaurants, marinas and similar water <br /> oriented uses with independent sanitary facilities and that are compatible with the <br /> natural resources of lakes and streams. <br /> 2. Compatibility: The Shoreline Commercial zone must be riparian and <br /> should be established adjacent to existing Shoreline Commercial zones.
