1. System One on the westerly shoreline of the point, when completed, will contain a total of 10 slips and will extend 60 feet into the water from the shoreline and will be 125 feet wide. There will be no impact to aquatic vegetation in the area where this system is to be installed. 2. System Two, located on the easterly side of the point below the bluff area, will contain a total of 12 slips when completed and will extend approximately 140 feet into the water from the shoreline and will be 150 feet in width. This system is located between two of the former mobile home pads located on the point before it was acquired by Wilderness Resort Villas, LLC. The owners of the mobile sites had cleared two beach areas each approximately 100 feet wide and removed any aquatic vegetation that may have been there. However, there is now some aquatic vegetation (reeds and bulrushes) separating the two beach areas, that needs to be removed to make the proposed second beach and the docking system functional. A permit to remove this vegetation will be obtained from the DNR. Minnesota Administrative Rule 6280.0350 Aquatic Plan Control provides that control (of aquatic plants) may be allowed on more than 100 feet of shoreline owned by resorts. Further, Minnesota Administrative Rule 6280.0250 relating to Standards for Aquatic Plant Management permits provides in subpart 3a criteria for issuing permits where there is "the presence of aquatic plants or nuisances that are interfering with a permit applicant's ability to use watercraft, swim, or engage in other traditional recreational uses." This rule allows Wilderness to apply for a permit from the DNR to remove aquatic vegetation on more than 100 feet of shoreline by Dock System No. 2. Based on the fact that Pequot Lakes Zoning Ordinance 17.511 allows up to 25% of the resort's shoreline (in this case up to 663.25 feet) to be improved, Wilderness Resort is requesting the amended CUP allow for this aquatic vegetation removal subject to issuance of a permit by the DNR. 4
