January 15, 2015 Staff Report Page 3 <br /> <br /> <br />4. Open Forum <br /> <br /> David Kennedy - 29064 Voyagers Pass. David Kennedy addressed the <br />Council regarding a lot split that he previously had approved by the Planning <br />Commission. His issue was with the 2nd condition that was placed on the lot <br />split requiring him to provide a new certificate of survey for tract A. Mr. <br />Kennedy requesting the City to rescind the added condition and approve the <br />application as originally presented. <br /> <br /> Dawn Bittner stated that the condition was placed on the split because the <br />City was aware of MnDOT’s plans with the surrounding property and <br />because the parcel should not be subdivided without an access. <br /> <br />6.1. Planning Commission Report <br /> <br /> Report received by Council. <br /> <br />6.2. Request to Rezone from Agriculture to Rural Residential – David and <br />Christine Kennedy <br /> <br /> Dawn Bittner presented the staff report. She explained that the Kennedy’s <br />are proposing to rezone a 41.96 acre tract of land from agriculture to rural <br />residential. The Planning Commission held a public hearing on the request <br />and recommends that the ordinance amendment be approved based on the <br />findings of fact presented in the council report. <br /> <br /> COUNCIL MEMBER AKERSON MOVED TO ADOPT ORDINANCE 14-08 <br />AMENDING THE OFFICIAL ZONING MAP FOR THE CITY OF PEQUOT <br />LAKES. COUNCIL MEMBER GARDNER SECONDED THE MOTION. <br />MOTION CARRIED 5-0. <br /> <br />6.3. Consider Ordinance Amendment Regarding Subsurface Sewage Treatment <br />Systems <br /> <br /> Dawn Bittner presented the staff report. She noted that the City’s current <br />ordinance adopted Crow Wing County’s ordinance by reference. The MPCA <br />is recommending that the City adopt the County’s Ordinance in its entirety <br />rather than by reference. <br /> <br /> COUNCIL MEMBER SJOBLAD MOVED TO ADOPT ORDINANCE 14-09 <br />OF THE CITY CODE TO REGULATE SUBSURFACE SEWAGE <br />TREATMENT SYSTEMS AND MAKING TECHNICAL AMENDMENTS TO <br />CHAPTER 17, SECTIONS 3.2 DEFINITIONS, 4.5 BUILDINGS <br />STANDARDS AND SECTION 7.7 SANITATION STANDARDS. COUNCIL <br />MEMBER GARDNER SECONDED THE MOTION. MOTION CARRIED 5-0.
