JURISDICTIONAL TRANSFER AGREEMENT BETWEEN <br /> CROW WING COUNTY AND THE CITY OF PEQUOT LAKES <br /> FOR SEGMENTS OF COUNTY STATE AID HIGHWAY (CSAH) 11 AND CR 112 <br /> AND STATE HIGHWAY 371 BETWEEN CR 107 AND CSAH 17 <br /> This Agreement is made and entered into by and between the County of Crow Wing, State of <br /> Minnesota, a political subdivision of the State of Minnesota, 326 Laurel Street, Brainerd, Minnesota, <br /> 56401, hereinafter referred to as "County", and the City of Pequot Lakes, Minnesota, a political <br /> subdivision of the State of Minnesota, 4638 County Road 11, Pequot Lakes, MN 56472, hereinafter <br /> referred to as the"City". <br /> WITNESSETH <br /> WHEREAS,the State of Minnesota intends to construct a 4-lane expansion of State Highway 371 <br /> within the limits of Pequot Lakes, including a bypass of the existing downtown area, that will <br /> change traffic patterns and roadway functions in the immediate area, and <br /> WHEREAS,the State intends to transfer roadway jurisdiction of the existing segment of State <br /> Highway 371 between CR 107/CR 168 to CR 112 (3.2 miles)to the County upon completion of <br /> said 4-lane expansion, and <br /> WHEREAS, following completion of the 4-lane expansion of State Highway 371, a portion of the <br /> existing 3.2 mile segment of State Highway 371, as well as portions of CSAH 11 and CR 112 will no <br /> longer be needed for County roadway purposes, and <br /> WHEREAS, Minnesota Statutes 163.11 authorizes the County to revoke County Roadways to the <br /> City by Resolution of the County Board and Minnesota Statutes 162.02 authorizes the revocation of <br /> County State Aid Highways to the City by joint action of the County Board and Commissioner of <br /> Transportation, and <br /> WHEREAS,both parties agree that 2.78 miles(from CR 107 to CSAH 17)of the aforementioned 3.2 <br /> miles of State Highway 371, all segments of CSAH 11 west of the proposed westerly roundabout <br /> ramp head, and all portions of CR 112 west of the proposed 4-lane expansion of State Highway 371, <br /> as shown in Exhibit A, shall revert to the City and become City Streets. <br /> NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br /> I. Effective Date; Survival of Terms <br /> This agreement will be effective on the date last signed by the parties. This agreement will <br /> remain in effect until the State has served a notice of release identifying the effective date of release <br /> to the County for State Highway 371, and payments (if any) have been made as required by this <br /> agreement. This effective date of release will serve as the actual date of the transfer of portions of <br /> State Highway 371, CSAH 11 and CR 112 from the County to the City. <br /> II. Identification of Roadway Segments <br /> The roadway segments covered in this agreement are as shown in Exhibit A and described as <br /> follows: <br /> 1 <br />
