City Council Minutes <br /> August 4, 2015 <br /> Page 3 <br /> Sergeant Turcotte clarified that if there are additional issues with Mya then there <br /> would be further requirements that the dog owners would have to abide by such <br /> as additional insurance requirements, outside limitations for the dog, muzzling, <br /> and spay or neutering. <br /> Mr. Fennell reiterated the incident that occurred and stated that Mya was <br /> protecting his son and the neighbor's son from the other growling dogs and this <br /> was not a random act. <br /> Mayor Sjoblad asked for further comments or questions. Upon hearing none, <br /> Mayor Sjoblad closed the public hearing and began deliberations with the <br /> Council. <br /> Mayor Sjoblad expressed his understanding of Mr. and Mrs. Fennell's situation; <br /> however, State statute dictates that if the dog is not earmarked as a potentially <br /> dangerous dog and a further incident occurs, the City becomes liable. Mayor <br /> Sjoblad favored the potentially dangerous dog classification for Mya. <br /> Mrs. Fennell asked if Mya could be placed on the potentially dangerous dog list <br /> on a temporary basis. <br /> Sergeant Turcotte stated that Mr. and Mrs. Fennell can appeal this decision after <br /> six months if there are no further incidents with Mya. <br /> Chief Klang noted that Mr. and Mrs. Fennell have brought forth new information <br /> on the children witnessing the growling of the other dogs. <br /> Sergeant Turcotte explained that the Chief's role is to look at both sides of the <br /> incident and present this to the Council. <br /> Mayor Sjoblad explained that to be responsible, the City should place Mya on the <br /> potentially dangerous dog list with the possibility of an appeal in six months. <br /> Sergeant Turcotte clarified the appeals process and timeline. <br /> Mr. and Mrs. Fennell were satisfied with the appeals process and timeline. <br /> MAYOR SJOBLAD MOVED TO ADOPT RESOLUTION 15-19 FINDINGS, <br /> CONCLUSIONS AND ORDER OF PEQUOT LAKES CITY COUNCIL ON <br /> HEARING REGARDING PEQUOT LAKES POLICE DEPARTMENT'S JULY 12, <br /> 2015 POTENTIALLY DANGEROUS DOG DECLARATION. COUNCIL <br /> MEMBER KARR SECONDED THE MOTION. MOTION CARRIED 3-0. <br /> Mayor Sjoblad adjourned the meeting. <br />
