ROADWAY TURN BACK MEMORANDUM OF AGREEMENT <br /> BETWEEN CROW WING COUNTY AND THE CITY OF PEQUOT LAKES <br /> This Agreement is made and entered into this day of June 16, 2015, by and between the County of <br /> Crow Wing, a political subdivision of the State of Minnesota, 326 Laurel Street, Brainerd, <br /> Minnesota, 56401, hereafter referred to as "County", and the City of Pequot Lakes,4638 County <br /> Road 11, Pequot Lakes, Minnesota 56472, hereafter referred to as "City". <br /> The purpose of this agreement is to document the background and results of recent turn back <br /> negotiations conducted by the County and the City. Recording a tentative agreement outlining <br /> monetary obligations will allow both parties to proceed with confidence as the formal turn back <br /> agreement is drafted. <br /> RECITALS <br /> 1. The Minnesota Department of Transportation(MnDOT)has determined that it is necessary to <br /> construct a 4-lane expansion of Trunk Highway(TH) 371 from Nisswa to Jenkins. <br /> 2. The 4-lane expansion includes a bypass of the City and the construction of a diamond <br /> interchange within the City's corporate limits. <br /> 3. After completion of the bypass, MnDOT will relinquish jurisdiction of the portion of existing <br /> TH 371 that lies within the City between County Road (CR) 107/168 and County State Aid <br /> Highway(CSAH) 17. <br /> 4. The County has tentatively agreed to accept the TH 371 roadway segment from MnDOT in <br /> exchange for$4,200,000. <br /> 5. The County has requested that the City accept the TH 371 roadway segment as a turn back <br /> from the County for the same amount. <br /> 6. The County has also requested the City to accept jurisdiction of all portions of CSAH 11 and <br /> CR 112 located west of the future TH 371 bypass. <br /> 7. The County cost participation policy stipulates City cost sharing for interchanges, but does <br /> not designate specific percentages. <br /> 8. The City's cost obligation for the interchange is a key consideration when determining <br /> acceptance of the proposed turn back segments from the County. <br /> 9. The County and City have come to a tentative agreement on the momentary obligation of both <br /> parties regarding the proposed roadway turn backs and interchange. <br /> 10. A formal turn back agreement will be presented to the full County Board and City Council for <br /> final consideration. The future document will include more detail regarding timing of <br /> jurisdictional changes and payments, environmental clearances and other considerations. <br />
