ARTICLE 3 <br />I►\ /_\►/_reL��1��11�7�elIY Ky <br />3.1 The Union recognizes the right of the Employer to operate and manage its affairs in all respects, <br />subject to compliance with applicable laws and regulations. All prerogatives, rights, and authority <br />which the Employer has not officially abridged, delegated, or modified by express terms of this <br />Agreement are therefore retained by the Employer. <br />3.2 The Employer retains the right to maintain and improve efficiency; to determine the quality and <br />quantity of work performed; to hire, promote, demote, classify, transfer, layoff, and suspend <br />employees, to discipline or discharge any employee for just cause, and to retain employees; to <br />determine the number of employees to be employed and the amount of supervision; to assign and <br />delegate work; to enter into contracts for the furnishing and purchasing of supplies and services; <br />to make, enforce and alter, from time to time, reasonable rules, policies and regulations, and to <br />require employees to observe the Employer rules, policies and regulations, which rules, policies <br />and regulations will be posted at time of implementation; to schedule work, to determine the <br />number of hours to be worked, and the extension, limitations, curtailment -or cessation of <br />operations or any part thereof; to determine the methods and equipment to be utilized and the type <br />of services to be provided; to change, modify, or discontinue existing methods of service and <br />equipment to be used or provided; to contract or subcontract, after meeting and conferring with <br />the Union, work normally done or which could be done by employees covered by this <br />Agreement; to determine the utilization of technology; to establish, modify, eliminate or <br />otherwise change the organizational structure; to determine qualifications for positions, determine <br />the content of any job and the duties assigned thereto, and the methods and techniques of work; to <br />evaluate the performance of all employees; and to manage and administer the Employer's <br />operations. <br />ARTICLE 5 <br />UNION SECURITY <br />5.1 The employer shall deduct from the wages of the employees who authorize such a deduction, in <br />writing, an amount necessary to cover monthly Union dues. Such monies shall be remitted as <br />directed by the Union. <br />5.2 The Union agrees to indemnify and hold the Employer harmless against any and all claims, suits, <br />orders, or judgments brought or issued against the Employer as a result of any action taken or not <br />taken by the Employer under the provisions of paragraph 5.1 of this Article. <br />5.3 The Union may designate employees from the bargaining unit to act as a Steward and an alternate <br />and shall inform the Employer in writing of such choice and changes in the position of Steward <br />and/or alternate. The Steward shall not leave work duties for Union business without prior <br />permission of the Police Chief or designee and the Steward shall notify the Police Chief or <br />designee upon the Steward's return to work duties. Time spent by the Steward away from work <br />duties shall not be considered paid work time. However, if a grievance meeting with the <br />Employer or a. meeting with the Employer at which the Steward's attendance is approved by the <br />
