AGREEMENT BETWEEN CITY OF PEQUOT LAKES AND LAW ENFORCEMENT LABOR SERVICES LOCAL 490, POLICE DEPARTMENT UNIT PREAMBLE The City of Pequot Lakes, hereinafter referred to as the "Employer," and Law Enforcement Labor Services Local 490. Law Enforcement Labor Services, hereinafter referred to as the "Union" representing employees in those classifications covered by this Agreement, do hereby enter into this Agreement for the purpose of setting forth the full and complete understanding of the parties regarding terms and conditions of employment of the bargaining unit members. This Agreement incorporates the entire understanding of the parties and shall supersede and replace all previous agreements between the parties hereto. ARTICLE 1 RECOGNITION 1.1 Law Enforcement Labor Services, shall be recognized as the sole and exclusive collective bargaining agent for a bargaining unit of employees defined as follows: All Police Officers employed by the City of Pequot Lakes Police Department, Pequot Lakes, Minnesota, who are public employees within the meaning of Minn. Stat. 179A.03, subd. 14, excluding the Chief of Police Sergeant, supervisory, confidential and all other employees. ARTICLE 2 EMPLOYER SECURITY 2.1 Neither the Union, its officers or agents, or any employee in the bargaining unit, will engage in, encourage, sanction, or support any strike, or the withholding in whole or in part of the full performance of their duties during the life of this Agreement, except as specifically allowed by the Public Employment Labor Relations Act of 1971, as amended. 2.2 The failure or refusal on the part of any employee to comply with the provisions of this Article 2 may result in immediate discipline up to and including discharge, which shall be subject to the grievance procedure. 2
