20.2 A shift differential of f; y e„ts ($ W one dollar $( 1.00) per hour will be paid for hours worked <br />between 6:00 p.m. and 6:00 a.m. (1800-0600 hours). Shift differential will also apply to holiday <br />hours worked shifts and injury on Duty. Shift differential does not apply to Toward Zero Death <br />(TZD) shifts, holiday pay (hours not worked), worker's compensation hours, and all personal time <br />off. Shift differential overtime calculation will be the hourly rate multiplied by time and one-half <br />plus the shift differential amount (I.e., $20.00/hr. x 1.5 + $.50 = $30.50). <br />An employee shall be eligible for a one (1) step movement on January 1 of each year subject to <br />receiving a satisfactory performance evaluation. The denial of a step advances due to failure to <br />receive a satisfactory performance evaluation shall be subject to the grievance procedure. <br />The Employer, at its discretion, may place a newly hired employee at a higher step in the pay plan <br />based on Job -relevant experience and training. The Employer, at its discretion, may advance an <br />employee up to, one (1) additional step upon successful completion of the probationary period. <br />ARTICLE 21 <br />SAVINGS CLAUSE, MODIFICATIONS <br />21.1 This Agreement is subject to the laws of the United States and the State of Minnesota. In the <br />event any provision of this Agreement shall be held to be contrary to law by a court of competent <br />Jurisdiction from whose final judgment or decree no appeal has been taken within the time <br />provided, such provision shall be voided. The voided provisions may be renegotiated at the <br />written request of either party. All other provisions shall continue in full force and effect. <br />21.2 Finality. This Agreement constitutes the full and complete Agreement between the parties. This <br />Agreement may only be modified or changed by written agreement executed by duly authorized <br />representatives of both parties. <br />18 <br />
