installed, hundreds of trees are going to come down. Be sure to include clearing and
-- grubbing necessary to do this.
#11: Placement of Docks: DNR must approve and will be part of plan in January.
Mr. Miller stated they have a meeting scheduled with them and will have written
comments from that meeting in January.
#12: Road in Bluff and Shoreline Setback: The road has not been removed. It is a 2
rut trail. They will incorporate that in with the trail so there will be o new
construction in this area. An emergency vehicle needs to have the trail 10 feet wide.
The First Responders have a 4-wheeler that pulls a dog sled type sled on wheels, not
requiring the 10-foot trail
#17 & 18: Beach Construction and Grading on Westerly Shoreline: The dates were
missed. They were approved with the amended CUP. The sand that was added to the
westerly shoreline will remain. Whether they need a CUP will depend on the volume
of the grading.
Rezoning of common space has been taken care of. Staff was directed to develop
report of outstanding conditions.
Mr. Miller stated that the Wilderness Resort Villas documents were filed with the
original plat. To make changes was rather simple,a series of documents needed to be
approved by the owners. With the Supplemental Plat, additional real estate was
added, the garage area. The original Common Interest Community was not set up as a
Flexible Common Interest Community. A Flexible Common Interest Community
allows you to add real estate to it. They cannot add additional real estate to the
common interest community for the garages and tie the two together via documents
where they cannot be separated. They have prepared 2 dedication pages and 2 plats
instead of one. One is a re-plat of the resort area and the new plat is the garages. To
make this a Flexible Common Interest Community requires a unanimous consent of
all owners, plus the mortgagees. It is very difficult to obtain the consent of the
lenders. They are not changing the association, just separate pages for the garages.
They are requesting to file the amended Final Plat for the Wilderness Resort Villas
only, without the garages. Staff will need to get an opinion from the City Attorney.
The Planning Commission did not have a problem with this.
Staff was reminded to issue permits only after the 125%bond or cashiers check
received.
MINUTES 11
Pequot Lakes Planning Commission
November 20, 2008
