Information received in our office <br /> via email on May 26,2023 has been reviewed pursuant to the responsibilities given the State Historic <br /> Preservation Officer by Section 106 of the National Historic Preservation Act(54 U.S.C.§306108)and its <br /> implementing federal regulations,"Protection of Historic Properties"(36 CFR Part 800).This project has also <br /> been reviewed pursuant to the responsibilities given the State Historic Preservation Office by the Minnesota <br /> Historic Sites Act(Minn.Stat.138.665-666)and the Minnesota Field Archaeology Act(Minn.Stat. 138.40). <br /> We have completed a review of your letter dated May 26,2023,a submission which included documentation in <br /> support of your agency's efforts to identify historic properties within the Area of Potential Effect for the <br /> proposed federal undertaking. <br /> Define Undertaking and Area of Potential Effect <br /> We understand by your May 26th letter that the City of Pequot Lakes has been awarded a federal Land and <br /> Water Conservation Fund(LCWF)Grant for the redevelopment of Trailside Park.The scope and nature of the <br /> proposed federal undertaking is clearly described and documented in your May 26th submission.The LCWF <br /> Grant Program is administered by the National Park Service(NPS),and the NPS has delegated the initiation of <br /> Section 106 for undertakings funded under this federal grant program to the Minnesota Department of Natural <br /> Resources(MnDNR).This delegation authorizes the MnDNR to act as NPS's agent to assist in meeting the <br /> requirements of Section 106 of the National Historic Preservation Act. <br /> We agree that your agency's definition of the Area of Potential Effect(APE),as described and documented in <br /> your May 26th submission,is generally appropriate to take into account the potential direct and indirect effects <br /> of the proposed federal undertaking as we currently understand it. <br /> Identification of Historic Properties <br /> The following comments and recommendations are based upon the information provided to our office in your <br /> May 26th submission and archaeological and historic/architectural inventory data included in our current <br /> inventories. <br /> MINNESOTA STATE HISTORIC PRESERVATION OFFICE <br /> 50 Sherburne Avenue a Administration Building 203 I.
