Staff was directed to create a list as a starting point.
Chairman Woog opened the public hearing.
APPLICANT: Mary Rosemore-Hammer
Applicant requests a Conditional Use Permit.
Applicant is present. Mr. Marohn explained the Staff Report. Finding of Fact Number
13 should be amended to be Shoreline Residential and Commercial. The Planning
Commission acknowledges that applicant plans to use the entire area, not 50% of the
garage and the Ordinance does prohibit retail sales of items not made on site. The
Findings of Fact do support the allowance for the sale of items used in quilting. Staff
recommends approval.
No public comment.
Applicant had no questions.
The Planning Commission asked why is the retail sales criteria is included in the
ordinance? Retail sales from a garage in the middle of the Agriculture zone would not be
in direct competition with commercial businesses. A home occupation would be a gun
smith shop; a gun shop would be a commercial use
A motion was made by Tom Adams, seconded by Bill Habein, to approve the
Conditional Use Permit, acknowledging that the applicant plans to use the entire garage
area and that retail sales of quilting items will take place, based on the following Findings
of Fact:
1. The applicant is proposing to make the quilts and keep all materials inside an 864
square foot accessory building.
2. The applicant will maintain a residence on the property. The quilt shop will be
incidental to the use of the property for residential purposes.
3. The applicant is proposing to use the entire accessory structure for the quilt shop.
4. The proposed hours of operation are from 10 a.m. to 5 p.m. Monday through
Saturday and some Sundays. The proposed business will not require any on street
parking.
5. The applicant is proposing to have one employee.
6. The applicant has stated the quilts will be made onsite in the quilt shop. The
supplies used to make the quilts are from a distributor out of Minneapolis.
Supplies to make the quilts will be sold from the premises.
7. No articles for sale will be visible from the street.
8. The activities that will be conducted do not cause noise, vibration, smoke, dust,
fumes or litter.
9. The applicant is proposing approximately two parking spaces on the premises.
Minutes 4
Planning Commission
September 18, 2008
