Employer in writing of the names of such Union representatives and of their <br /> successors when so designated as provided by Article 5.3 of this Agreement. <br /> 6.3 Processing of a Grievance: It is recognized and accepted by the Union and the <br /> Employer that the processing of grievances as hereinafter provided is limited by <br /> the job duties and responsibilities of the employees and shall therefore be <br /> accomplished during the normal working hours only when consistent with such <br /> employee duties and responsibilities, and subject to the approval of the Employer. <br /> The aggrieved employee and a Union representative shall be allowed a reasonable <br /> amount of time without loss of pay when a grievance is presented to the Employer <br /> during normal working hours provided that the employee and the Union <br /> representative have notified and received the approval of the Employer, based on <br /> the Employer's determination that such absence is reasonable and would not be <br /> detrimental to the work programs of the Employer. <br /> 6.4 Procedure: Grievances, as defined by Article 6 shall be resolved in conformance <br /> with the following procedure: <br /> Step 1. An employee claiming a grievance as defined in this Article 6 shall, <br /> within fourteen (14) calendar days after the date of the first event giving rise to the <br /> grievance, or in the case of a pay grievance within fourteen (14) calendar days -� <br /> after the employee's receipt of the first pay check showing the grievable pay <br /> amount, present such grievance to the Police Chief. The Police Chief will discuss <br /> and give an answer to such Step 1 grievance within seven (7) calendar days after <br /> receipt. A grievance not resolved in Step 1 and appealed to Step 2 shall be placed <br /> in writing setting forth the nature of the grievance, the facts on which it is based, <br /> the provision or provisions of the Agreement allegedly violated and the remedy <br /> requested. The grievance shall be appealed to Step 2 within seven (7) calendar <br /> days after the Police Chiefs final answer in Step 1. Any grievance not appealed <br /> in writing shall be considered waived. <br /> Step 2. If appealed, the written grievance shall be presented by the Union to the <br /> City Council. If the grievance has been properly and timely appealed, the City <br /> Council shall set a time to hear the grievance within fourteen (14) calendar days <br /> after the Step 2 appeal is received. After the meeting the City Council, they shall <br /> give the Union the Employer's answer in writing within seven (7) calendar days <br /> after the meeting. The City may elect to have the grievance heard and answered <br /> by a committee of the City Council or by the City Council. <br /> A grievance not resolved in Step 2 may be appealed to Step 3 within seven (7) <br /> calendar days following the City's written answer in Step 2.
