A IN
L A W• 0 I f tC h,
Page 2
August 27, 2008
previously conveyed to the City, resulting in the City acquiring fee title to the property, in order
for the City to convey this parcel to Wilderness Resort Villas, LLC the City must vacate the
roadway/parcel. In addition a section of High Pine Street within the Plat of Metter Point as
identified on the attached Sketch and Description, is also proposed to be vacated. My
understanding is that there is no current City Street located within the platted area of High Pine
Street.
I am suggesting that if the City approves the two road vacation resolutions (portion of High Pine
Street within the Plat of Mettler Point and the extension of High Pine Street in Government Lot 2
and 3) that a condition of approval of the road vacation and final plat would be for the Developer
to provide a permanent thirty-three (33) foot easement for ingress and egress, with a centerline
description over the existing roadway identified on the final plat, to provide access to those
properties that abut the sixty-six (66) foot parcel currently owned by the City. The attached
Sketch and Description identifies the location of the proposed ingress and egress easement.
Easements would need to be provided by Wilderness Resort Villas, LLC to the individual
properties owners affected by the road vacations.
I have reviewed the proposed road vacation resolutions, copies of which are in your city council
packet. The end result should benefit all parties including the adjacent property owners that do
not have recorded easements for ingress and egress.
If you have any questions, please contact me. Thank you.
Very truly yours,
Paul J.
