MEMORANDUM Experts in Small Town Planning <br /> Date: August 27, 2008 <br /> To: Mayor and City Council <br /> From: Charles Marohn <br /> Re: Wilderness Point, Request for Road Vacation <br /> Planning Analysis <br /> The developer of Wilderness Point Resort is requesting a road vacation,which is <br /> necessary to complete a re-platting process at the resort. The preliminary re-plat has <br /> been approved by the City Council and the final plat is recommended for approval at the <br /> September meeting. <br /> In reviewing the subdivision request, the Planning Commission worked with the <br /> developer to propose the road vacation. Doing the vacation provides a couple of key <br /> benefits to the subdivision and the impacted property owners. <br /> 1. It provides room for additional screening and buffering between the resort units <br /> and the adjacent properties. The Planning Commission has required additional <br /> screening in this area. <br /> 2. The developer has agreed to provide a dedicated ingress/egress easement to the <br /> adjacent property owners to allow them to access their property through the <br /> resort. <br /> The right-of-way being vacated serves no purpose, either to the City or to the adjacent <br /> property owners. The right-of-way is isolated currently, cut off from any other right-of- <br /> way. The terrain is difficult and not conducive to road construction. The property <br /> owners currently drive through the resort property now to access their property. There <br /> is very little likelihood of a road ever being built in this section of right-of-way. <br /> This vacation, and the granting of the permanent easement,would codify a situation <br /> that has informally existed for some time, to the benefit of all.
