He noted that the Planning <br /> Commission reviewed the required conditional use permit and preliminary <br /> plat. The Planning Commission approved the conditional use permit and is <br /> recommending approval of preliminary plat. <br /> COUNCIL MEMBER NAGEL MOVED TO APPROVE PRELIMINARY <br /> PLAT FOR WILDERNESS RESORT VILLAS, LLC, BASED ON <br /> FINDINGS OF FACT LISTED IN THE APRIL 21, 2008 PLANNING <br /> COMMISSION REPORT. MAYOR MALECHA SECONDED THE <br /> MOTION. <br /> Council Member Ryan had questions regarding the conditions for the plat. <br /> Chuck Marohn indicated that the conditions are part of the conditional use <br /> permit on the property. <br /> MOTION CARRIED 5-0. <br /> 6.2. Ordinance Amendment — Conservation Design <br /> COUNCIL MEMBER SJOBLAD MOVED TO ADOPT ORDINANCE 08-06 <br /> AMENDING CHAPTER 17 OF THE CITY CODE RELATING TO <br /> CONSERVATION SUBDIVISIONS. COUNCIL MEMBER ORASKOVICH <br /> SECONDED THE MOTION. <br /> Council Member Ryan indicated that he has some concerns relating to this <br /> ordinance amendment. He questioned whether people have been <br /> informed of this ordinance. Chuck Marohn noted that the Planning <br /> Commission held a public hearing however there was no public present to <br /> discuss the ordinance. Tom Ryan noted that although he is in agreement <br /> with the need for this type of ordinance, he feels that this particular <br /> ordinance adds an extra burden for someone who wants a conventional <br /> subdivision due to the requirement of a conditional use permit. He <br /> indicated he would rather give the applicant a choice of a conventional <br /> subdivision without having to go through the conservation design process. <br /> Tom Ryan also questioned whether this ordinance fits within the concept <br /> of the comprehensive plan. Chuck Marohn indicated that it is consistent <br /> with the comp plan. <br /> Council Member Nagel questioned if it was necessary that the <br /> conventional design be done as a conditional use? Council Member Nagel <br /> stated that he has the same concerns as Council Member Ryan.
