NEW BUSINESS—CONDITIONAL USE PERMIT DISCUSSION <br /> Agenda Item: 5.1 <br /> Background Information: Mayor Gardner requested the Planning <br /> Commission review the necessity for Conditional Use Permits (CUP) in <br /> commercial areas for business activities that should be allowed. <br /> A conditional use is a use that is generally allowed but requires additional review <br /> by the planning commission instead of being approved administratively by staff. <br /> The commercial conditional use permit application fee is $450 + $46 recording <br /> fee. The average review time for a conditional use permit from the time of <br /> submittal is one month. Conditional use permit applications are reviewed by the <br /> planning commission after a public hearing (notification is surrounding <br /> neighbors/notice in newspaper). The planning commission bases their decision <br /> on the CUP review criteria in ordinance. Conditions of approval may be added to <br /> CUPs in order to mitigate potential concerns regarding the proposed use of <br /> property. Conditional Use Permits are transferrable to subsequent property <br /> owners and are valid/in compliance as long conditions of the permit are being <br /> met. The city has the authority to revoke a conditional use permit if the <br /> conditions of the permit are not being fulfilled. <br /> The city lists several uses in the land use matrix which are "permitted uses" (e.g. <br /> Artist's Studio, Auto Repair, Child Care Center, etc.). The matrix also lists uses <br /> that require a conditional use permit in the commercial zone (e.g. Animal <br /> Boarding Facility, Brewery/Taproom, Health Club or Spa, etc.). If a commercial <br /> use is proposed which is not listed in the land use matrix it generally falls under <br /> the category, "Commercial Use, (Other, Not Classified)" and requires a <br /> conditional use permit. <br /> The city may modify the code to allow additional (any/all?) commercial uses as <br /> "permitted uses"and not require a conditional use permit. <br /> The table below lists the CUP requests over the past 5 years: <br /> USE REQUIRED BY: <br /> Operate a Shuttle Service Commercial Use,Other <br /> Dock&Lift Service Commercial Use, Other <br /> Plumbing&Residential Use in C zone Commercial Use, Other AND Matrix <br /> Sports Facility&School Matrix <br /> Xcel Service Center Matrix(Patriot Zone) <br /> Apartment in LI zone Matrix <br /> Apartment in LI zone Matrix <br /> Manufacturing in DMU zone Commercial Use, Other <br /> Pequot Lakes Staff Report 5.1-1 <br /> July 21,2022 <br />
