be provided shall be determined solely by the Responding Official, and <br /> FURTHER PROVIDED that the Responding Official may at any time <br /> recall such Assistance if the Responding Official deems such recall is <br /> necessary to provide for safety and protection of the Party under which <br /> authority the Responding Official is acting. <br /> Subd. 3. When a Responding Party provides Assistance under this Agreement, they <br /> may in turn request Assistance from other Parties as "back-up" during the <br /> time that they are providing Assistance outside their service area. <br /> Subd. 4. Assistance provided under this Agreement shall be under the command of <br /> the officer-in-charge of the Requesting Party for which the Assistance was <br /> summoned. For the purposes of the Minnesota Municipal Tort Liability <br /> Act (Minnesota Statutes, Chapter 466), the employees and officers of the <br /> Responding Party are deemed to be employees (as defined in Minnesota <br /> Statutes, Section 466.01, subdivision 6)of the Requesting Party. <br /> Subd. 5. Each Party shall be responsible for injuries or death of its own personnel. <br /> Each Party will maintain workers' compensation insurance or self- <br /> insurance coverage, covering its own personnel while they are providing <br /> Assistance pursuant to this Agreement. Each Party waives the right to sue <br /> any other Party for any workers' compensation benefits paid to its own <br /> employee or volunteer or their dependants, even if the injuries were <br /> caused wholly or partially by the negligence of any Party or its officers, <br /> employees or volunteers. <br /> ARTICLE 6. INSURANCE <br /> Each of the Parties shall maintain insurance policies providing coverage <br /> for: <br /> (a)Workers compensation for firefighters who are members of said <br /> Parties' fire department, the coverage of said policy extending to protect <br /> said firefighters when engaged in the performance of duties under this <br /> Agreement outside the service area of the Party whose fire department <br /> he/she is a member of Each Party also agrees to provide workers' <br /> compensation coverage for all other of their own personnel who provide <br /> Assistance pursuant to this Agreement. Each Party waives the right to sue <br /> any other Party for any workers' compensation benefits paid to its own <br /> employee or volunteer or their dependants, even if the injuries were <br /> caused wholly or partially by the negligence of any other Party or its <br /> officers, employees, or volunteers. <br />
