City Council Minutes <br />June 3, 2014 <br />Page 3 of 4 <br />Mayor Adams questioned whether Mr. Dahl had received the ietter <br />regarding a notice of immediate correcti�e action from the Attarney sent in <br />February. Mr. Dahl iRdicated that he did receive the letter, that he talked to <br />Dawn Bittner and that he has taken care o# all the s#uff that was supposed <br />to be cleaned up. <br />Council Member Pederson sta#ed that the Cifjr has records of the past <br />many years on this issue. He fnformed Mr. Dahl #hat Planning and Zoning <br />has worked with him many times during the past se�eral years on this <br />issue. He informed Mr. Dahl #hat a!I o� the stuff on the grouncf needs to be <br />gone. He further explained the need for the City to take action on this <br />issue due to the number of years that this situation has been on-going ar�d <br />due to the number of compiair�ts the City has recei�ed and continues to <br />recei�e. <br />Mayor Adams closed tt�e public heari�g. <br />Attorney Robert Scott re�iewed the findings of fact and conclusions listed <br />in a resofution. He informed #he Council that �he findings ha�e to be basec� <br />on the e�idenee. He recommended that because Mr. Dahl has testified <br />that he doesn't ha�e �he animais listed in the resol�ation that the Council <br />omit paragraph 2d XI I under findings. He explained that the Resolution <br />gi�es the property owner until June 17th to come in#o compliance. If the <br />conditions are not met by the 17t�', a court order to ha�e property cleaned <br />up will be requested. He also suggested t�at if the property owner makes <br />a good faitF� effort and is nearly done with the clean-up by the 17th, the <br />City can make a judgmeR� to extend the time for a couple of weeks. <br />Mayor Adams questior�ed Mr. Dahl as to whether the City would be <br />allowed to access his property to see that improvements have been made. <br />Mr. Dahl indicated that he would allow the City to access the property but <br />he did not want any pict�res taken of the proper#y. <br />Counci[ Member Sjoblad informed Mr. Dahf that once this is clea�ed up, <br />the Gity does not want it to start o�er again. <br />MAYOR ADAMS MOVED TO ADOPT RESOLUTION 14-10 FINDINGS, <br />CQNCLUSIONS AND ORDER OF PEQUOT LAKES CITY COUNCfL <br />REGARDING ALLEGED CODE VIOLATlONS AND NUISANCE <br />CONDITIONS AT 3952 COUNTY ROAD 1T, AND OMiTTING ITEM 2D <br />(xii) REFERRING TO THE ANIMALS. COUNCIL MEMBER SJOBLAD <br />SECON�ED THE MOTfON. MOTION CARRIED 4-0. <br />12. Adjournment <br />
