Applicant was present as well as Pat Barrett. <br />Mr. Marohn explained the applicant has added additional property and screening. The <br />proposal does meet the requirements with conditions. Condition Number 4, second <br />sentence, the word "are" should be "area ". Staff recommends approval of the <br />Conditional Use Permit. There is an assumption that the Planning Commission would <br />also look favorably on the metes and bounds subdivision later in the agenda. This <br />development requires a development agreement. <br />Mr. Tucci added that this is the plan discussed last month and worked with Staff. They <br />removed a little of the hard surface from the northeast corner, added native grass areas <br />`.. and along the MN/DOT ditch area. They added trees to the landscape plan. <br />M <br />Public comment: <br />Mark Meixner: The additional Retail Space, any idea what that will be? Bank, food, <br />photo service? <br />Mr. Tucci stated that as he has stated publically in the past, they plan to make application <br />for a liquor license. If that doesn't happen, they will look at other uses. <br />Public comment closed. <br />Construction of the service road was discussed, as well as the sewer connection. Mr. <br />Marohn stated that as part of the discussion for the development agreement these issues <br />will be debated at the Council level. <br />Mr. Barrett stated that MN/DOT has stated that after development the volume of water <br />going to the MN/DOT pond or right -of -way cannot exceed amount of water today. Mr. <br />Marohn stated that the catch basins drain to the rear of the building; most of the <br />stormwater goes to the back of the building. <br />Mr. Tucci stated that the hours of operation are still being debated.
