ME City Council Minutes September 1, 2009 Page 6 of 11 6.1. Rezoning from Rural Residential to Light Industrial by Hunt Technologies Report presented by Chuck Marohn. Chuck stated that the Planning Commission recommends the rezoning request be approved based on findings of fact submitted by the Planning Commission. COUNCIL MEMBER RYAN MOVED TO APPROVE ORDINANCE 09 -05, THE REZONING REQUEST FROM HUNT TECHNOLOGIES FROM RURAL RESIDENTIAL TO LIGHT INDUSTRIAL BASED ON 5 FINDINGS OF FACT AS LISTED IN THE AUGUST 25, 2009 PLANNING COMMISSION REPORT. COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION CARRIED 5 -0. 6.2. Ordinance Amendment Establishing Grow Zone Standards Staff report by Chuck Marohn. Chuck Marohn stated that the grow zone provides standards to streamline the permitting process in the downtown mixed use zone. He stated that presently most uses require conditional use permits. Mr. Marohn explains that this ordinance is an alternative to the present standards. He indicated that the Planning Commission has �..- recommended approval of the ordinance amendment. Council Member Nagel questioned if the parking regulations are we too restrictive. Chuck noted that this issue will still need to be addressed. COUNCIL MEMBER NAGEL MOVED TO ADOPT ORDINANCE 09 -06 AMENDING CHAPTER 17 RELATING TO ESTABLISHING A GROW ZONE OVERLAY DISTRICT. COUNCIL MEMBER RYAN SECONDED THE MOTION. MOTION CARRIED 5 -0. COUNCIL MEMBER SJOBLAD MOVED TO APPROVE PUBLICATION OF A SUMMARY ORDINANCE FOR ORDINANCE 09 -06. COUNCIL MEMBER MALECHA SECONDED THE MOTION. MOTION CARRIED 5- 0. 6.3. After - the -Fact Permit for Lonesome Cottage This item was withdrawn from the agenda. 6.4. Request by CLA Properties to Vacate Portions of First Street and Second Street Justin Bolz - Andolshek addressed the Council regarding his request to vacate portions of First Street and Second Street.
