Mr. Hallan stated that his home is zoned Rural Residential and didn't understand why <br />this use would be something that could be done on his 5 acre lot. Mr. Marohn stated that <br />the City doesn't have any regulations that would govern that use on a property; it is not a <br />structure, not a use, but may be more than a utility. Mr. Hallan stated it is supporting a <br />commercial use. Mr. Habein stated that if it required a conditional use permit, screening <br />could be controlled. <br />Mr. Williams called for a Point of Order. The meter farm is not part of this application. <br />The property owner seems to have some hesitation with the Planning Commission not <br />moving forward with the rezone. <br />Mr. Marohn explained that a non - conforming use, once stopped, in considered <br />discontinued after 6 months. However, this site continued as it had been. The site was <br />not used as anything else. There are other structures that could be used, but no others are <br />set up the way this one is. <br />A motion was made by Scott Pederson, seconded by Tom Adams, that this request would <br />not require rezoning to commercial and it would also not require a Conditional Use <br />Permit. <br />Mr. Hallan stated the building was never moth balled and was sitting vacant. <br />Mr. Marohn stated that there is no requirement to take action and we could note the <br />�- Conditional Use Permit application as withdrawn. Staff would send a letter to applicant <br />that Planning Commission and Staff determined the application was not necessary and <br />had been withdrawn. The application could also be tabled and discussed at a future <br />meeting. <br />Staff needs to discuss in greater detail the Rezone application. The Rezone needs a <br />supermajority vote. It is acceptable to Hunt Technologies to table the rezone and to meet <br />to discuss what should take place. <br />Scott Pederson amended the previous motion to remove the statement regarding the <br />rezone. Tom Adams seconded. All members voted "aye" to the amendment and the <br />motion. Motion carried. <br />A motion was made by Bill Habein, seconded by Mark Hallan, to table the rezone <br />request. All members voted "aye ".
