The hearing was for a Conditional Use Permit, which was approved and does not <br />require Council action. There were also two After -the -Fact Permit Fees for which the <br />commission has made recommendations and forwarded to the council: <br />i. Jason Laxen — After- the -Fact Permit: <br />Mr. Laxen constructed a small shed without a Land Use Permit. Mr. Laxen explained <br />that he was a first time homeowner and did not realize he needed a permit for something <br />without a permanent foundation. He is planning a wood floor and blocks. He stated that <br />he stopped construction of the shed after receiving notification from the City. If he <br />removed the shed the matter would be resolved. He could then apply for a permit. <br />The Planning Commission recommends a $50.00 After -the -Fact Permit Fee, based on <br />the following Findings of Fact: <br />Findings of Fact <br />i. Mr. Laxen ceased construction upon notification from City; <br />2. The structure is 96 sq. ft.; <br />3. The structure could be removed easily; <br />4. Construction of the shed meets all zoning requirements; <br />5. A Land Use Permit could be obtained and shed put in place. <br />2. Lonesome Cottage Furniture Company — After- the -Fact Permit: <br />In 2007 Mr. Andersen received a Land Use Permit for an 8o' X 340' commercial <br />building. That building would have met the maximum permit fee of $5,000 for a <br />commercial building. Since that time two accessory structures have been constructed <br />that are not a part of any application. <br />The Planning Commission recommends a fee five times the original fee (Original <br />fee= $68o), based on the following Findings of Fact: <br />Findings of Fact <br />1. The accessory structures were constructed without a permit; <br />2. Property owner had knowledge of the rules; <br />3. These structures were not part of the original plan granted special <br />fees; <br />�- 4. The special fees did not meet the maximum threshold; <br />5.
