Submit AIA Document G707, "Consent of Surety to Final Payment„ Also,for your information regarding Liquidated Damages;the amount we have withheld is$6,500.00. Here is what is included in Specification Section 00 7300-Supplementary Conditions to the General Conditions: SECTION 8.3 DELAYS AND EXTENSIONS OF TIME 5. Add the foilowing Paragraph 8.3.7 as follows: "8.3.7 Contractor and Owner recognize that time is of the essence of this Agreement and that Owner will suffer damages if the Work is not completed with the times specified in the Project Manual,plus any extensions thereof allowed in accordance with the General Conditions. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Woric is not comp/eted on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay(but not as a penalty), Contractor shall pay Owner the amount of$500.00 for each day that expires aRer the time specified in Section 01 1000 of the Project Manual for Substantial Completion until the work is substantially complete. Payment of liquidated damages shall be in the fom►of a Change Order reducing the Contractor's Contract Sum by the amount of the liquidafed damages. If the Contractor refuses to sign the Change Order for liquidated damages, the Owner reserves the right to unilaterally reduce the Contract Sum by the amount of the liquidated damages. If the amount of the liquidated damages exceeds the remaining unpaid balance of the Contract, the Contract Sum shall be reduced by the amount of the unpaid balance and the Contractor shall pay the Owner the difference between the liquidated damages and the unpaid balance." We have issued the Certificate for Substantial Completion to establish the date, which was signed and returned.
