b) The City agrees to accept, at a minimum, the following materials for residential recycling: <br /> �. Glass, tin/aluminum cans, newspaper, plastic, cardboard, and other materials as mutually <br /> agreed upon by the City and contracted refuse/recycling hauler. <br /> Record Keeping <br /> a) The City hereby agrees to maintain its books and records to show separate accounts for the <br /> funds received under this grant,and to maintain records of expenditures adequate to identify <br /> the purposes for which grant funds have been expended. <br /> b) The City hereby agrees to permit the CWCWMD or its designee, at its request, to have <br /> complete access to the City's files and records for the purpose of making such financial <br /> audits,verifications,and investigation as it deems necessary concerning the grant. In so far as <br /> providing such information does not cause the City to violate the Data Practices Act, the <br /> CWCWMD will expect compliance. Any costs incurred for an audit would come out of the <br /> City's Recycling Fund. <br /> C) The City hereby agrees to maintain such files and records for a period of at least four years <br /> after completion or termination of the program. <br /> Reporting <br /> The City hereby agrees to submit the following information to the County. <br /> a) Upon request, a progress report identifying the use of grant funds in accordance with the <br /> budget as submitted with the grant proposal. <br /> b) At a minimum provide a quarterly progress report(a monthly one is preferred)identifying the <br /> number of tons of recyclable material generated through the City's recycling program. <br /> C) Upon request, a progress report outlining the participation rate of residents from single and <br /> multifamily dwellings utilizing the City's recycling program. <br /> d) Reports are to be issued directly to the CWCWMD. <br /> INDEMNIFICATION <br /> The County will not be liable for any acts of the City,its agents or employees. The City will hold harmless and <br /> defend the County, its officers and employees against any and all liability, loss, costs, damages, expenses, <br /> claims or actions,including attorney's fees which the County,its officers and employees may hereafter sustain, <br /> incur or be required to pay,arising out of or by reason of any act or omission of the City,its agents,servants or <br /> employees, in the execution, performance or failure to adequately perform its obligations pursuant to this <br /> Agreement. <br /> TERMINATION <br /> Either party may cancel this Agreement,with or without cause,by providing written notification at least ninety <br /> (90)days before the date of cancellation. <br />
