W. Lind suggested building retaining walls rather than the north pond to catch the water. <br />The existing retaining walls are stopping the stormwater. The runoff issue is below the <br />driveway. He would like to add retaining walls and curb it even more. <br />Mr. Marohn stated that in general, the retaining walls are providing an area to collect <br />stormwater. <br />When asked, Mr. Lind stated the retaining wall behind the house will be removed when <br />the basement is built. That area will become lawn. <br />The Design for the ISTS has been submitted. <br />Public Comment: None. <br />Mr. Marohn explained that the Variance is for a basement where the crawl space is and <br />making the basement 2 feet higher. <br />Vice -Chair Adams stated he would like to add a condition that once the project is <br />finished there would be an inspection that would confirm the height increase is 2 feet and <br />the impervious coverage does meet the less than 25% requirement. <br />When Mr. Lind asked about his timeframe, Mr. Marohn explained that he would need to <br />act within 12 months (apply for a permit in 12 months) and then he would have 24 <br />months to finish the exterior. <br />A motion was made by Bill Habein, seconded by John Derksen, to approve the Variance <br />request, based on the following Findings of Fact: <br />1. The subject property is located at 30367 Pequot Boulevard and is zoned Shoreline <br />Residential. <br />2. The subject property is on Sibley Lake which is a General Development Lake. <br />3. The proposed SSTS would be approximately 7 feet from the road right -of -way, <br />while normally 10 feet is required. <br />4. The existing dwelling is 52.3 feet from the OHW, while 75 feet is required. The <br />footprint of the existing structure will remain the same. <br />5. The proposed SSTS would encroach approximately 4 feet into the sideyard <br />setback of the southern property line. <br />6. The maximum amount of impervious coverage allowed is 20 %. Currently the <br />property contains 32.8% impervious coverage. With the proposed removal of <br />impervious surfaces, the final coverage of the parcel would be 24.7 %. <br />7. The existing height of the building is 19 ft, with the additional two courses and <br />increase in roof pitch, the height of the dwelling will be 21 ft. <br />8. The property owner has the right to replace the structure with a structure of the <br />exact dimensions, footprint, roof pitch, etc. <br />9.
