City of Pequot Lakes <br />Wildlife Trail and North Sluetter Road Improvements <br />Preliminary Assessment Hearing <br />Tuesday, December 7, 2010, 6:00 p.m. <br />A. Summary of Steps in an Assessment Project <br />(per Minnesota Statute, Chapter 429) <br />1. Initiation of proceedings. They may be initiated by the City Council or by <br />a petition of affected property owners. <br />2. Preparation of a feasibility report. The Engineer or other competent <br />person must prepare a report (including estimated cost) on the proposed <br />improvement. <br />>>> 3. Public (preliminary assessment hearing on the proposed <br />improvement. The City must post notices in the City's official newspaper(s) <br />as well as mail notices to individual property owners in the proposed <br />assessment area. At the hearing, the City Council should give interested <br />people a chance to be heard. When a petition signed by 100 percent of the <br />landowners requests the improvement, the City Council may order the <br />improvement without a hearing. <br />4. Ordering the improvement and preparation of plans. The City <br />`-- Council votes on whether or not to proceed with the improvement. If they do <br />so, the Engineer should prepare the necessary plans and specifications. <br />5. Improvements are bid. The City Council accepts the plans and calls for <br />construction bids. The project is advertised, and bids are received and <br />opened. The City Council votes on whether or not to accept the bids. <br />NOTE that No. 6 and No. 7 can be switched <br />6. Improvements are constructed. If the City Council votes to accept <br />(usually) the low bidder, construction proceeds. <br />7. Final assessment notices and hearina on the improvement. A <br />proposed assessment roll is prepared listing the amount assessed against <br />each property that will benefit from the improvement. Following proper <br />newspaper and individual notices, a hearing is held to allow people to <br />express their concerns on the assessments. <br />8. Approval and certification of the assessment roll. After the hearing, <br />the City Council must approve the assessment roll so the Clerk can certify it <br />to the County Auditor. <br />Page 2 of 9 <br />
