City Council Minutes <br /> December 7, 2010 <br /> Page 7 of 11 <br /> COUNCIL MEMBER NAGEL SECONDED THE MOTION. MOTION <br /> CARRIED 5-0. <br /> 8. Fire Chief Report <br /> Council Member Ryan stated that there has been a proposal to add <br /> another township to the fire service area which will be discussed at a later <br /> date. <br /> 9. Police Department Report <br /> Report received by Council. <br /> 9.1. Prosecution Agreement with Matt Mallie <br /> COUNCIL MEMBER RYAN MOVED TO APPROVE THE <br /> PROSECUTION AGREEMENT WITH MATT MALLIE FOR <br /> PROSECUTION SERVICES FOR 2011. COUNCIL MEMBER SJOBLAD <br /> SECONDED THE MOTION. MOTION CARRIED 5-0. <br /> 10. Water Wastewater Monthly Report <br /> Report accepted by Council. <br /> 10.1. Request to Forqive Sewer Charges <br /> Tina Nolden stated that Earl Hemmerich is requesting the City to forgive <br /> sewer charges in the amount of$1,449.27 due to a waterline break. She <br /> stated that Earl Hemmerich was unable to attend; however, Paul Hertle — <br /> 8297 Eagle Lane, Breezy Point, was representing him. Tina noted that Mr. <br /> Hemmerich had the water lines repaired as soon as he noticed the leaks. <br /> Council Member Nagel stated that it would be an injustice to charge Earl <br /> for this. Council Member Ryan questioned how many times the City has <br /> forgiven Mr. Hemmerich these charges due to water line breaks. <br /> Council Member Sjoblad suggested that the City form a policy so that staff <br /> does not have to make these types of decisions. Council Member Sjoblad <br /> suggested forgiving part of bill and informing Mr. Hemmerich that this <br /> would be the last time that the City will forgive the sewer charges for <br /> instances such as this. <br /> COUNCIL MEMBER RYAN MOVED TO FORGIVE THE SEWER FEE OF <br /> `-- $1,449.27 WITH THIS BEING THE LAST AND FINAL TIME THAT THE <br />
