Payment of Claims Prior to a Council Meeting <br />The Clerk noted that there are times when vendors will not or cannot <br />remove late fees. She stated that staff would like authorization from <br />Council to pay claims prior to a Council Meeting to avoid the payment of <br />late fees or penalties. The Clerk explained that State Statute allows two <br />methods of processing claims before a meeting. The Clerk reviewed the <br />methods allowed by Statute. <br />COUNCIL MEMBER RYAN MOVED TO AUTHORIZE IMMEDIATE <br />PAYMENT OF CERTAIN CLAIMS IN WHICH LATE FEES CANNOT BE <br />AVOIDED UNDER THE FOLLOWING TWO METHODS: <br />1) PER STATUTE 412.271, SUBDIVISION 8 - DELEGATION OF <br />AUTHORITY FOR PAYING CERTAIN CLAIMS. <br />THE CLERK IS AUTHORIZED TO MAKE IMMEDIATE PAYMENT <br />OF CLAIMS FOR THOSE CLAIMS WHICH ARE REGULAR AND <br />RECURRING AND WHERE LATE FEES OR PENALTIES <br />CANNOT BE AVOIDED WITH THE FOLLOWING CONDITIONS: <br />• A LIST OF THE CLAIMS SHALL BE PROVIDED TO THE <br />COUNCIL FOR APPROVAL <br />• AMENDMENTS TO THE LIST SHALL BE APPROVED BY <br />COUNCIL <br />• THESE CLAIMS SHALL BE ADDED TO THE CHECK <br />REGISTER FOR COUNCIL APPROVAL <br />2) PER STATUTE 412.271, SUBDIVISION 4 — IMMEDIATE <br />PAYMENT OF CLAIMS. <br />IMMEDIATE PAYMENT OF CLAIMS MAY BE MADE FOR <br />CLAIMS THAT ARE NOT REGULAR AND RECURRING AND <br />WHERE LATE FEES OR PENALTIES CANNOT BE AVOIDED <br />WITH THE FOLLOWING CONDITIONS: <br />• THE CLAIM MUST BE ENDORSED BY A MAJORITY OF THE <br />COUNCIL MEMBERS <br />• THE CLAIM MUST BE ADDED TO THE CHECK REGISTER <br />FOR COUNCIL APPROVAL <br />
