� 1. Administrative Offense. An administrative offense is a violation of a provision of <br /> the City Code/Ordinance(s) and is subject to the administrative penalties set forth in the <br /> schedule of offenses and penalties referred.to in this Chapter, entitled"Offenses and <br /> Penalties",hereafter. <br /> Section 7-1.3. ADIVIINISTRATIVE ENFORCEMENT. <br /> 1. Orders to Correct;Administrative Citations. Any Officer of the City of Pequot <br /> Lakes Police Department, the City Administrator or his or her designee may,upon <br /> reasonable belief that there has been a violation,notify the violator, or in the case <br /> of a vehicular violation, attach to the vehicle, a notice of violation. Said notice <br /> shall set forth the nature, date and time of the violation,the name of the official <br /> issuing the notice, and order that the violation be corrected and code compliance <br /> achieved within a reasonable time not to exceed 30 days. If compliance is not <br /> achieved within the time specified in the order to correct, or if the violation <br /> subject to the order occurs at a property at which a violation of the City Code was <br /> found to occur under this Article at any time in the preceding three months,the <br /> official is authorized to issue an administrative citation stating the date,time, and <br /> nature of the ofFense,the name of the official issuing the citation, the amount of <br /> the scheduled administrative penalty, and the manner for paying the fine or <br /> appealing the citation by requesting an administrative conference. The citation <br /> shall be presented in person or by mail to the person responsible for the violation. <br /> �' 2. Administrative Penalty. A person responsible violating the City Code may be <br /> subject to an administrative penalty in an amount not to exceed the amount of the <br /> ma�cimum fine allowed if each ordinance violation had been prosecuted as a <br /> misdemeanor. <br /> Section 7-1.4. PAYMENT; REQUEST FOR ADMINISTRATIVE CONFERENCE. <br /> 1. The person responsible for the violation may either pay the scheduled civil fine to <br /> the City, request a conference with the official who issued the administrative <br /> citation within ten(10) calendar days after issuance of the administrative citation, <br /> or provide notice of withdrawal from the procedures outlined in this Article, in <br /> which case the violator may be immediately subject to criminal prosecution or <br /> civil legal action. The administrative conference, if requested, shall be with the <br /> City Administrator or his or her designee who has reviewed the underlying facts <br /> of the violation, the history of prior violations, the impact of the violation on <br /> adjoining properties, and any information provided by the person responsible for <br /> the violation. Based upon those facts,the official will determine if any settlement <br /> options may, consistent with the public health,welfare and safety,be offered to <br /> the person responsible for the violation as an alternative to the payment of the <br /> entire amount of the fine. This conference shall take place within 20 calendar days <br /> of the City's receiving the request. If a settlement cannot be reached at the <br /> � administrative conference, the person responsible for the violation may, at the <br /> conclusion of the conference, either pay the fine or appeal the same to an <br />
