� ORDINANCE NUMBER 18-09, SECOND SERIES AN ORDINANCE AMENDING CHAPTER 7,ARTICLE 1 OF THE CITY CODE REGARDING ENFORCEMENT OF ADMINISTRATIVE OFFENSES AND ISSUANCE OF PENALTIES RELATED TO THESE OFFENSES WITHIN THE CITY OF PEQUOT LAKES COUNTY OF CROW WING STATE OF MINNESOTA The City Council of the City of Pequot Lakes does ordain as follows: Puraose and Intent: The purpose of this ordinance amendment is to amend Chapter 7 of the Pequot Lakes City Code regarding the enforcement of administrative offenses and issuance of penalties related to these offenses. Amendment: Chapter 7,Article 1 shall be amended as follows: Section 7-1.1. PURPOSE Administrative offense procedures established pursuant to Sections 7-1.1-7-1.10 are intended to provide the public and the City of Pequot Lakes with an informal, cost efFective, and expeditious �-- alternative to traditional criminal charges for violations of certain City Code and Ordinance provisions. The procedures are intended to be voluntary on the part of those who have been chazged with administrative offenses.At any time prior to payment of the administrative penalty as is provided for thereafter,the individual may withdraw from participation in the procedures,in which event the City may bring criminal charges or initiate a civil legal action in accordance with law; likewise, the City of Pequot Lakes in its discretion may choose not to initiate administrative enforcement Sections 7-1.1-7-1.10 and may bring criminal charges in the first instance. In the event a party participates in the administrative procedwes established in Sections 7-1.1-7-1.10 but does not pay the monetary penalty which may be imposed,the City of Pequot Lakes will seek to collect the costs of the administrative ofFense procedures as part of a subsequent criminal sentence in the event the party is charged and is adjudica.ted guilty of the criminal violation. Any minor traffic offense subject to an administrative fine set forth in Section 7-1.11 shall be governed by that section. Section 7-1.2. DEFINITIONS Except as may otherwise be provided or clearly implied by context, all terms shall be given their commonly accepted definitions. For purposes of this Chapter the following words and terms when used herein sha11 have the following meanings unless the context clearly indicates otherwise. ��
