The following performance standards apply to all development in this zone: <br />B. Fences. Fences not exceeding 60 inches in height may be constructed except within the OHW setback area. <br />Fences not exceeding 36 inches may be constructed within the OHW setback area so long as the fencing is <br />transparent. Under no circumstances shall a fence be constructed closer than 10 feet from the surface of a public <br />road and in all cases not within the public right -of -way. Materials shall consist of usual fencing materials with posts <br />and fence of metal, wood, concrete, brick or smooth wire. Barbed or electrified wire is not to be used where <br />frequent human contact is anticipated. <br />Section 17 -5.15 LAND USE MATRIX <br />1. The land use matrix shown in Table 1 establishes the allowable, permitted, accessory, conditional and excluded <br />uses within the City of Pequot Lakes. <br />2. All uses are considered prohibited unless specifically allowed in this Code, even if they are not listed specifically <br />under excluded uses. <br />3. All accessory uses require a permit, unless otherwise indicated. <br />Comment. The land use matrix is the single point of inconsistency within the Code in addition to <br />conflicting with the City's Comprehensive Plan. This single point can not be the basis for staff <br />findings of fact as it does not consider the balance of the Code's overwhelming position against <br />this classification. <br />ARTICLE 7. PERFORMANCE STANDARDS <br />Section 17- 7.1SIGNS <br />1. Purpose. The purpose of these standards is to protect the general welfare and safety of the City by providing a <br />policy of aesthetic development to prevent signs from intruding on the rural and residential character of the City; <br />to provide adequate signs for direction and property identification purposes; and to provide adequate and <br />effective signs for commercial use. <br />4. General. <br />A. Non - maintained signs or signs for discontinued business will be removed after notification by the Zoning <br />Administrator or after discontinuance of the business. <br />B. Placement of signs shall consider protecting sight distance at intersections, driveways and curves. <br />D. A non - conforming sign may be refaced, removed and replaced for maintenance purposes, however it shall not <br />be increased in size, the support system shall not be improved and the sign shall be removed in it's entirety upon <br />the determination by the Zoning Administrator that the sign is in disrepair or the support system is failing. <br />E. Residential and commercial signs may not contain elements commonly used by highway departments to alert, <br />direct or caution traffic such as, but not limited to, octagonal stop signs or speed limit signs. <br />F. No signs, except for official traffic signs, shall be placed on or overhang public property, except where specific <br />permission is granted by the Planning Commission. <br />G.
