Previously Completed Actions: <br />❑ Monitor commercial development along roadways by adopting a zoning strategy that <br />strengthens the downtown commercial area permits sensible development, and retains <br />forested gateways leading into Pequot Lakes. <br />❑ Provide for orderly business development in clustered, properly zoned development areas in <br />the City. <br />❑ Designate a rural, urban, and rural /urban transition zone in order to maintain the integrity <br />of these distinct areas. Each zone should promote development that fits within the context of <br />existing development. <br />❑ Conduct research and seek professional help when needed to make informed land -use <br />decisions. <br />Section 17 -3.1. RULES <br />The language set forth in the text of this Chapter shall be interpreted in accordance with the following rules of <br />construction: <br />1. The word person includes a firm, association, organization, partnership, trust, <br />company or corporation as well as an individual. <br />3. The singular includes the plural and the plural includes the singular. <br />4. The present tense includes the past and future tenses and the future includes the <br />present. <br />5. The word "may" is permissive. The word "shall" is mandatory. Mandatory <br />compliance with the Ordinance shall allow for variances thereto. <br />7. The words "lot," "plot," "piece" and "parcel" of land are interchangeable. <br />8. The words "used for," shall include the phrases "arranged for," "designed for," <br />"intended for, improved for, " "maintained for," and "occupied for.' <br />Section 17 -3.2. DEFINITIONS <br />The following words shall be defined as follows for the purpose of this Chapter: <br />3. Abutting. Making direct contact with or immediately bordering. <br />4. Accessory Structure. A building or other structure that is supportive, secondary and subordinate in use and /or <br />size to the principle structure on the same parcel or lot which, because of the nature of its use, can reasonably be <br />located at or greater than minimum structure setbacks. Includes all structures not considered the principle <br />structure including, but not limited to, T.V. towers antennas, dish antennas, outdoor swimming pools, outdoor hot - <br />tubs, detached garages, sheds, guest quarters and boathouses. <br />5. Accessory Use. A use naturally and normally incident and subordinate to the main use of the premises. <br />7. Adjacent. In close proximity to or neighboring, not necessarily abutting. <br />8. Agent. Any person acting on behalf of a landowner in dealing with activities under the jurisdiction of the <br />Ordinance, including but not limited to realtors, contractors or attorneys. <br />Comment: The intended use for the properties in Breezy Pines subdivision is for family dwelling and <br />occupancy. The proposed dog kennel has switched the intended use of the primary structure <br />(house) and the accessory structure (shed). This is inconsistent with the intent of the Code. <br />Furthermore, there are 3 separate, mixed uses on the property and is not consistent with Home <br />occupation standards that all other businesses must comply with. <br />12. Animals, Domestic. Common household pets, such as dogs and cats, kept for amusement, companionship, <br />decoration or interest. <br />15. Animal Boarding Facility. An establishment that houses animals, other than those belonging to the occupant, <br />overnight or over an extended period of time. <br />16. Animal Grooming Establishment. An establishment principally engaged in grooming animals in which <br />overnight boarding is prohibited. <br />17. Animal Husbandry. The care or breeding of domestic animals such as cattle, hogs, sheep, horses, poultry, dogs <br />(more than two) or cats (more than three) for the occupants of a property. <br />Page 5 of 20 <br />
