MN Statute Section 462.363 supports the current effect and application of Breezy Pines <br />subdivision covenants. <br />Section 17 -2.1. THIS CHAPTER IS ADOPTED FOR THE PURPOSE OF: <br />1. Protecting the public health, safety, comfort, convenience and general welfare. <br />2. Inaugurating and effectuating the goals of the Comprehensive Plan. <br />3. Promoting order in development by dividing the area of the City into zones and regulating therein the location, <br />construction, reconstruction, alteration and use of the structures and land. <br />4. Conserving the natural and scenic beauty and attractiveness of the City, for the health and welfare of the public. <br />5. Providing for adequate light, air and access to property by regulating the use of the land and buildings and the <br />bulk of structures in relation to surrounding properties. <br />6. Providing for the administration of the provisions of the ordinance and defining the authority and duties of the <br />Administrator, Planning Commission, Board of Adjustment, Parks Committee and City Council under this <br />ordinance. <br />8. Promoting the economic well being of the community by providing an attractive, stable and viable venue for <br />new businesses. <br />Section 17 -2.2. RELATION TO LAND USE PLAN <br />It is the policy of the City of Pequot Lakes that the enforcement, amendment, and administration of this Chapter <br />be accomplished with due consideration of the recommendations contained in the Pequot Lakes Comprehensive <br />Plan as developed and amended from time to time by the Planning Commission and City Council as well as any <br />other City land use and development plans enacted from time to time. The City Council recognizes the <br />Comprehensive Plan as the policy for regulating land use and development. <br />Comment: Key Points of Pequot Lakes Comprehensive Plan that are in inconsistent with a Dog Kennel in a <br />`. residential development. <br />Intent statement 'Identify, preserve, and enhance the key social and physical resources that <br />contributes to Pequot Lakes' unique character and add to the quality of life for its residents." <br />Natural features. Pequot lakes is a gateway to the Central Lakes Region. Long -time residents, <br />newcomers, and visitors feel strongly connected to this north -woods landscape. Although rapid <br />population growth and improvements in transportation have the potential to boost Pequot <br />Lakes' local economy, citizens and visitors alike don't want economic development and <br />expansion to occur at the expense of their natural features. Future development that degrades <br />these resources can threaten the very assets that make Peauot Lakes a special and desirable <br />Ip ace. <br />POLICIES. The following policies are proposed to guide all future growth and development and <br />local government action in Pequot Lakes: <br />Protect and enhance landmarks, historic and archeological sites, social gathering places, and <br />natural features in Pequot Lakes. The City of Pequot Lakes wants its community character — <br />including the small town feel, natural features, social gathering places and events, and <br />recreational opportunities - to serve as the foundation for economic vitality and quality of life. <br />An increasingly large number of studies support this philosophy, with findings indicating that <br />communities taking steps to actively protect their distinct community assets clearly enhance <br />their economic potential, putting them at an advantage over other communities that don't <br />identify and preserve the components contributing to their community character. <br />Page 4 of 20 <br />
