that the house has not sold has nothing to do with the vet office. It has to do with the
economy; the house is in foreclosure and Mr. Thomas represents the bank.
Mr. Thomas further stated how much noise the dogs make is the issue and what
conditions can be set to deter it. It is not up to the applicant to come up with the proof.
Once the City made the decision to put a "C" in this district, it became allowed with
conditions. It is not a flat out approved use. It is not a permanent approval. It is a CUP
and the Planning Commission needs to determine what the conditions need to be.
Mr. Thomas also stated that someone said they knew the case included in his letter. It is
good law; he argued it in Crosslake and is the law on CUP's. As for OSHA comment,
the facility will be subject to a lot of regulations. Your Staff submitted a
recommendation with conditions and that is acceptable to the applicant. Mr. Thomas
requested approval with those conditions.
Diane Simchuck - requested conditions to prevent problems by limiting number of dogs,
a solid fence, and traffic congestion problems. This is in a residential area.
Kevin Littman — Breezy Pines does have covenants that include something about split
use. He uses his property to sit outside.
Karen Ettesvold — She has a home in Pequot Lakes. She needed to get a CUP for a
-- beauty shop and it has worked out well. Some of her neighbors were concerned because
of traffic; conditions were included on the number of cars parked there. It has worked
out fine. She would like them to have a chance to prove it will work.
Public Comment closed.
Mr. Hallan stated that he did not attend the meeting last month. We all make judgments
on personal experiences. The kennel where he boards his dogs only accepts dogs from 8
AM to 9 AM and 3 PM to 4 PM. The dogs are kept inside and are taken out individually
or his two dogs together. We need to be cognizant of the neighbors. He is concerned
with the hours. Will dogs come and go anytime during that stretch?
Mr. Garland stated that the hours may vary; there may be certain times for drop off and
the same thing at night.
Mr. Adams stated people could possibly drop off between 7:30 and 9 and pick up
between 4 and 6.
Mr. Garland stated it would be based on clientele.
Mr. Marohn asked Mr. Garland to explain the use of the outside fenced area. Mr.
Garland stated there would never be 25 dogs outside at one time. It would depend on the
, dogs, probably 4 to 5 with a staff person outside. At no time would any dogs be outside
