improvement of surrounding vacant property for uses predominant in the <br />�-- area. <br />C. The conditional requirements at public cost for public facilities and services <br />and will not be detrimental to the economic welfare of the community. <br />D. The conditional use will have vehicular approaches to the property which are <br />so designed as not to create traffic congestion or an interference with traffic <br />on surrounding public thoroughfares. <br />E. Adequate measures have been taken to provide sufficient off- street parking <br />and loading space to serve the proposed use. <br />F. Adequate measures have been taken or will be taken to prevent or control <br />offensive odor, fumes, dust, noise, and vibration, so none of these will <br />constitute a nuisance and to control lights and signs in such a manner, that <br />no disturbance to neighboring properties will result. <br />G. The conditional use will not result in the destruction, loss or damage of a <br />natural, scenic or historical feature of major significance. <br />H. The conditional use will promote the prevention and control of pollution of <br />the ground and surface waters including sedimentation and control of <br />nutrients. <br />Staff Findings: The Staff provides the following findings of fact addressing the issue of <br />the non - conforming use for consideration: <br />1. The subject property is located at 5634 County Road 1i and is zoned Rural <br />Residential. <br />2. The typical hours of operation for the proposed business are between 6 A.M. and <br />io P.M., 7 days a week. <br />3. The proposed use will primarily take place in an existing pole building and a <br />large, fenced in area. <br />4. The occupancy at any given time will be between 20 -25 dogs. <br />5. The proposed business is considered an Animal Boarding Facility and requires a <br />conditional use permit in the Rural Residential Zone. <br />6. The proposed fence is 7 feet in height while the ordinance has a 5 foot maximum <br />in the Rural Residential Zone. <br />7. The proposed sign for the business will be setback one foot from the Road Right <br />of Way and is 92 sq. ft. (6' x 8' two sided) while typically only a three (3) square <br />foot sign is allowed in residential zoning districts. <br />8. The use is an appropriate conditional use in the Rural Residential Zone. <br />9. The use with conditions, conforms to the comprehensive land use plan. <br />1o. The surrounding properties are zoned Rural Residential and Forest Management. <br />The proposed use is compatible with the existing neighborhood. <br />ii. The use with conditions, will not be injurious to the public health, safety, welfare, <br />decency, order, comfort, convenience, appearance or prosperity of the City. <br />12. Most activities at the facility will either be in the pole shed or fenced in area. The <br />conditional use will not impede the normal and orderly development and <br />improvement of surrounding vacant property for uses predominant in the area. <br />13. No new public facilities or services are required for the proposed use. <br />14. The proposed use will use existing vehicular approaches. Clients will be coming <br />and going at different times throughout the day, as to not create traffic <br />congestion or an interference with traffic on surrounding public throughfares. <br />`- 15.
