�-- 3. Lot, Use and Density Requirements. <br />Setback, sign - feet, minimum I i <br />4. Performance Standards. The following performance standards apply to <br />all development in this zone: <br />B. Fences. Fences not exceeding 6o inches in height may be <br />constructed except within the OHW setback area. Fences not <br />exceeding 36 inches maybe constructed within the OHW setback <br />area so long as the fencing is transparent. Under no <br />circumstances shall a fence be constructed closer than io feet from <br />the surface of a public road and in all cases not within the public <br />right -of -way. Materials shall consist of usual fencing materials <br />with posts and fence of metal, wood, concrete, brick or smooth <br />wire. Barbed or electrified wire is not to be used where frequent <br />human contact is anticipated. <br />Section 17 -7.1 regulates the use of all signs. <br />E. Signs in Residential, Agriculture and Forestry Districts, provided <br />they meet the following standards. <br />(1) Signs shall not be internally or externally lighted but may <br />be reflective. <br />(2) No sign shall be larger than 3 square feet, except for a <br />permitted home occupation where 6 square feet is allowed, <br />(3) Only one sign per parcel shall be allowed. <br />Since this application is a Conditional Use Permit, the CUP provisions contained in <br />Section 11.6, Subdivision 3 also apply. Those provisions include the following: <br />1. The following must be met: <br />A. The use or development is an appropriate conditional use in the land use <br />zone. <br />B. The use or development, with conditions, conforms to the comprehensive <br />land use plan. <br />C. The use with conditions is compatible with the existing neighborhood. <br />D. The use with conditions would not be injurious to the public health, safety, <br />welfare, decency, order, comfort, convenience, appearance or prosperity of <br />the City. <br />2. The following must be considered: <br />A. The conditional use should not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purpose permitted on that <br />property, nor substantially diminish or impair values in the immediate <br />vicinity. <br />`-- B.
