That <br /> way a property owner on the other side of town couldn't request to be in the Overlay <br /> District. <br /> Chair Hallan stated he was under the impression from earlier discussions that we would <br /> be looking at an Overlay District that would apply to certain zoned properties adjacent <br /> to Trunk Highway 37i right-of-way. Planning Commission Member Leckband <br /> concurred. <br /> Planning Commission Member Wilson stated it was his understanding this has been <br /> rushed to help the businesses in downtown Pequot. He thought we had looked at the <br /> maps to see where other signs could be located. Mr. Burslie stated Staff has not had the '� <br /> opportunity to study the entire corridor and where the ideal locations for offsite signs 'i <br /> would be. This is the application before us. Zoning Specialist Bittner stated that the I <br /> Sign Committee's request was for two signs at this location,with a third one in the <br /> future on the plateau by County Road i68. �, <br /> Planning Commission Member Leckband inquired by limiting the e�ctent of the overlay ', <br /> district to one parcel do we not put ourselves as risk for legal action? Chair Hallan ��, <br /> stated a property owner could make application to include their Commercial or ��i <br /> Industrial property in the overlay district. These applications would be reviewed on a i <br /> parcel by parcel merits to be included or not in the overlay district. Mr. Burslie stated '�, <br /> the City Attorney had reviewed this and provided case law and determined it does not '� <br /> open up any liability. � <br /> Vice-Chair Wallin stated at the last meeting there were 6locations provided on a map. I <br /> Mr. Burslie stated that was to show spacing. Chair Hallan stated those properties were � <br /> on either Commercial or Industrial property, not on residential properties. � <br /> Planning Commission Member Leckband inquired if it would be beneficial to include �'I <br /> language that the Overlay District could not extend more than X number of feet east or ' <br /> west of the centerline of the highway. Mr. Burslie stated this is a case by case basis. , <br /> Staff would help the applicants through the process. <br /> Chair Hallan stated it is the intent of this Commission that the Overlay District be along � <br /> Trunk Highway 37i corridor and that is how it will be viewed in the future for any future <br /> applicants coming in. <br /> PUBLIC COMMENT OPENED: <br /> Steve Anderson, Franklin Outdoor Advertising— It seems the City is creating a <br /> monopoly as the only people to get signs is the City. If someone can go through the I� <br /> process later to be included,why not include them now. Council Member Akerson I <br /> stated all of the properties should be included.
