Motion carried.
OLD BUSINFSS:
Enforcement Policy
Bittner ecplained the City Council had indicated a desire to streamline our enforcement
of Code violations. Administrative Citations have been included in our Code for several
years but we did not have a policy outlining how they would be used. The City
Administrator, City Attorney, City Prosecutor and Staff are recommending the
Enforcement Policy be adopted to enforce property maintenance and other offences
outlined on the Offense Timeline.
Bittner further elained the amount of time spent sending lawn mowing letters and the
need to only send one letter and to follow noncompliance with an Administrative
Citation. Discussion ensued whether or not to include enforcement for garbage in this
manner. It was the consensus of the Planning Commission to not include enforcement
of garbage violations in this manner due to the few complaints received and the
complexity of a garbage violation.
The Administrative Penalty Ordinance was reviewed, as well as the Administrative
Citation. When asked, Bittner stated this policy is not being established as a revenue
source, but as a way of gaining compliance with the City Code. Other than lawn mowing
offenses, property owners violating the City Code will receive two letters prior to
receiving an Administrative Citation. Once they receive the Administrative Citation,
they may request an Administrative Conference, and ultimately a hearing with the City
Council.
The Administrative Penalty Ordinance will not require a public hearing as it is contained
in Chapter;the amendment to Article i2, Enforcement,in Chapter will require a
public hearing to include the penalty amount of$10o per day.
A motion was made by Planning Commission Member Leckband, seconded
by Planning Commission Member Wilson, to recommend the City Council
adopt the Enforcement Policy.
Bittner noted the motion should also include a recommendation to the City Council to
revise F.xhibit B of the Fee Schedule.
Planning Commission Member Leckband amended his motion to
recommend the City Council adopt the Enforcement Policy and to revise
Exhibit B of the 2oi8 Fee Schedule to include Administrative Penalties in
the amount of$ioo per day, with a$i,000 maximum penalty per year.
MINUTES 8
Pequot Lakes Planning Commission
June zi, 2oi8
